No, Newt did not endorse the Obamacare mandate - Le?gal In?sur ...

The blog Verum Serum claims to have found?an audio recording showing that Newt Gingrich supported Obama?s federal mandate, in a?post titled Gingrich Called for ObamaCare Mandate in May 2009?.

Breitbart TV?picked up on that theme, asserting ?this is the first example of Gingrich specifically endorsing President Barack Obama?s federally mandated version which many conservatives believe is unconstitutional and Gingrich has described as ?clearly unconstitutional.?

This is wrong.? I have listened to the entire audio recording, and Newt does not endorse the Obamacare mandate, in part because the speech took place before even the earliest draft of Obamacare had been proposed.

The actual discussion in the recording?is nothing new, listen for yourself, it?shows Newt saying what he has said before about not allowing free riders at hospitals including either having insurance or showing that you have the ability to pay.? You can like it or not, but it?s not new or news, as Verum Serum acknowledges in its post.

The recording does not support the conclusion?that Newt supported Obama?s federal mandate, which uses the police powers of the state to force people to buy insurance or face penalties.

At the time of Newt?s presentation, in May 2009, the earliest versions of Obamacare had not yet been released.? Newt specifically notes that the details of what would be proposed were unknown and (at 27:00) the process was still in the ?wish list press conference stage.?

The initial version of Obamacare was not released until early June 2009.? My first blog post about the early draft (the Senate?HELP?Committee version)?of Obamacare was on June 16?regarding the CBO assessment.? Various iterations of Obamacare were proposed throughout June?-August.? The Obamacare legislation and mandate eventually focused on using the IRS?as the enforcer.

The Verum Serum recording was before there was a specific proposal, much less a specific Obamacare mandate which turned into enforcement through tax returns and penalties.

It is not true, at least not based on the May 2009 recording posted at Verum Serum, that Newt supported the Obamacare mandate.

Update:? Ugh, Breitbart TV doubles down, ?But, newly discovered audio from a conference call in May 2009 shows that Mr. Gingrich praised the individual mandate put forth by President Obama.?

Water trucked to nearly bone-dry Texas town

SPICEWOOD, Texas (AP) ? Under dark clouds and rain, two tanker trucks for the first time delivered thousands of gallons of water Monday to a Texas town that came precariously close to becoming the state's first community to run out of water during a historic drought.

The 8,000-gallon water delivery arrived in Spicewood after it became clear the village's wells could no longer produce enough water to meet the needs of the Lake Travis community's 1,100 residents and elementary school, said Clara Tuma, spokeswoman of the Lower Colorado River Authority.

Several towns and villages in Texas have come close to running out of water during the driest year in Lone Star State history, but until now none has had to truck in water. Most found solutions to hold them over, often paying tens of thousands of dollars to avoid hauling water, a scenario that conjures up images from the early 1900s, when indoor plumbing was a novelty.

In reality, water still ran Monday through pipes and faucets of the Central Texas town, though the source will soon be different. Instead of being pumped from wells into the community's 129,000-gallon storage tank ? a two day's supply of water ? the already treated liquid will be hauled in from 17 miles away, treated a second time and put into the town's water system.

"The hauling of water is just a Band-Aid approach. It's just a short-term approach," said Joe Don Dockery, a Burnet County commissioner that oversees the Spicewood area.

LCRA realized last week how dire the situation was, and informed Dockery on Monday. By the next day, the situation was worse ? the well had dropped another 1.3 feet overnight. The severest forms of water restrictions were put in place, and LCRA said there would be no new hookups to the town's water supply.

Ryan Rowney, manager of water operations for the LCRA, said the agency plans to truck water into Spicewood for several more weeks while exploring alternatives, including drilling a new well or piping water from nearby Lake Travis. But the agency doesn't want to rush into any project, and prefers for now to pay $200 per truckload of water while ensuring the tens of thousands of dollars it will cost to find a permanent solution are well-spent.

"If we need to haul every day, we will. This will probably go on for several more months," Rowney said.

Trucks, including at least one 6,000 gallon tanker, will make about four or five deliveries a day, he said, but the town will still have to remain under the severest water restrictions.

"All you can do is take a bath, a shower, and that's really all you're allowed to do. You can flush the commode, but even that we're asking people to do judiciously," Rowney said.

Spicewood is a community about 35 miles from Austin, home to many retirees who spend their weekdays in the city and drive to their lakeside homes on the weekends. Residents are now being careful, taking shorter showers, and some are even bringing their clothes to Laundromats.

Until last week, when it became clear they could run out water, the most exciting event in Spicewood was the upcoming wild game chili cookoff advertised on a roadside sign at the entrance to the small community.

"When we had water it was pretty nice here," deadpanned Riley Walker a 73-year-old state transportation employee.

Walker bought land in Spicewood in 1988 when only a handful of families lived here. He built a house and moved into town full time in 2002.

"I have faith they will haul water in. They don't really have a choice, there are a lot of people here," Walker said.

Joe Barbera, president of the local property owner's association, said residents have been "really worried about this for a long time now," but have always been conservation minded.

"You look around and you don't see any immaculate lawns," he added. "This is just normal use for a normal community."

For more than a year, nearly the entire state of Texas has been in some stage of severe or exceptional drought. Rain has been so scarce lakes across the state turned into pools of mud. One town near Waco, Groesbeck, bought water from a rock quarry and built a seven-mile pipeline through a state park to get water. Some communities on Lake Travis moved their intake pipes into deeper water. And Houston started getting water from an alternative, farther away reservoir when Lake Houston ran too low.

And even though it has started to rain more this winter, it's not enough to fill the arid state's rivers and lakes.

A few inches of rain certainly won't be enough to fill Spicewood's wells.

"We're talking about rainfall events of 20 inches plus. Huge, huge flood events to bring the lake levels up," Rowney said, explaining that many parts of Texas can no longer wait for the rain. "The downside of that is that everyone's praying for a flood, well floods can be bad too."

TV recovered; Rome men charged with burglary

An ETC flat screen television valued at $200 that was stolen from a Callier Springs Road residence in Rome was recovered by the Floyd County Sheriff?s Office officials who arrested two Rome men for the burglary Wednesday evening, according to Floyd County Jail records.

According to records:

Derricus Devonte White, 19, of 3 Skyland Drive, was arrested and charged with burglary.

Devante Japal Daniels, 19, of 15 West Dale Drive, was arrested and charged with burglary and violating probation.

The two remained in jail Wednesday night without bonds.

Gunman who shot at federal buildings pleads guilty

A Virginia man pleads guilty to shooting at several military-related buildings in 2010. NBC's Pete Williams has the video Yonathon Melaku created one of the nights he was out shooting.

The man who shot at the Pentagon in late 2010 and other military related targets in the Washington, D.C. area pleaded guilty Thursday in federal court in Virginia.

After the plea was entered, prosecutors released a video he made, which shows him in his car, firing shots from a handgun.

Yonathan Melaku, 23, admitted he committed five separate shootings in October and November 2010 -- twice at the National Museum of the Marine Corps, and once each at the Pentagon and at Coast Guard and Marine Corps recruiting offices in Virginia.?He fired the shots late at night or early in the morning, using a 9 mm handgun.?No one was hurt, but the government says that repairs will cost over $100,000.


On the tape, which Melaku made during the night he shot at the Marine Corps museum for the second time, he can be heard saying: "That's a military building, and that's the building I'm going to be targeting. ... Last time I hit them, they turned off the lights for, like, four or five days."

He can be seen waving his gun at the camera. At another point in the tape, he begins firing.?The shots can be heard and the muzzle flash from the gun seen.

Melaku also records himself wearing a mask and then later removes the mask, showing his face.

He was arrested last June near Arlington National Cemetery at 1:30 am.?A search of his home turned up what investigators said were potential components of a homemade bomb.

RIM and BlackBerry on the edge under new CEO (Reuters)

TORONTO/LONDON (Reuters) ? Takeover talk swirled around Research In Motion on Monday as investors and analysts pondered whether new Chief Executive Thorsten Heins had been appointed to lead a turnaround of the struggling smartphone maker or prepare it for sale.

Heins, who joined the company that makes the BlackBerry in 2007 and took over the top job on Saturday when co-CEOs Mike Lazaridis and Jim Balsillie resigned, said he wants to do a better job in rolling out innovative new products to get ahead of the competition. But he argued the company doesn't need seismic change.

Still, key shareholders and analysts alike signaled they are impatient for drastic improvement at a company that has lost market share and market value after being comprehensively outplayed by the likes of Apple and Google.

"If Thorsten really believes that there are no changes to be made, he will be gone within 15 to 18 months. He will be a transitional CEO and this will be a transitional board," said Jaguar CEO Vic Alboini, who leads an informal group of 16 RIM shareholders holding just under 10 percent of the company's shares.

Alboini criticized the retention of Balsillie and Lazaridis on RIM's board and called for several other board members to step down before the company's mid-year annual meeting.

"If we're wrong, prove us wrong," Alboini said in an interview, referring to the group of shareholders who support his view. "This group is not going anywhere. This is just putting RIM in a position where it might be able to get back into the game. It's early days."

RIM's U.S.-listed shares climbed 4.1 percent to $17.69 in premarket trade on Monday.

RIM looks badly in need of a leader that can rejuvenate both the design and operational sides of the business or prepare it for sale to one of a raft of rumored buyers, its critics said.

"If there are no meaningful signs of an imminent turnaround then I think the spotlight will turn back on to the assets that RIM holds and who they might be attractive to," CCS Insight analyst Ben Wood told Reuters.

"The annual analyst event in May will now become the focal point to the unveiling of Thorsten's vision. We know the speed with which you make strategic changes and implement them is absolutely critical because the mobile phone business will not stand still."

On the surface, the former Siemens AG executive appeared to suggest he would stick to the current strategy, but analysts expect that to change in the coming months.

RIM's existing product lineup has struggled to compete with Apple's iPhone and iPad and the slew of large-screen and powerful devices from Samsung and other manufacturers using Google's Android operating system.

U.S. WOES

First on the agenda will be a need to improve execution, with a particular focus in North America where RIM has hemorrhaged market share after a year marked by product delays and a botched launch of its PlayBook tablet.

"It takes nine months for a product to get to market once you have thought about what you want to do," Gartner analyst Carolina Milanesi told Reuters. "They are looking at least a year from a transitional perspective.

"Picking Thorsten is a sign that they haven't quite decided that (a sale is what) they want to do, so they might give it yet another shot at looking at the business and trying to come back".

As the window for a turnaround closes, the clamor from shareholders for the company to license its technology to third parties or even sell the business has got louder.

"RIM's Achilles heel is its hardware focus," said Victor Basta, managing director at Magister Advisors.

"IBM is a very rare exception to the rule, but it took them a decade to transition from a hardware to a software focus. RIM does not have the luxury of a decade."

Investors have seized on any rumor of a deal, whether with Amazon as reported by Reuters in December or with Samsung last week, as reason to celebrate.

NOKIA IN THE FRAME

Analysts have said that logical buyers for RIM also include fellow-struggler Nokia, perhaps with support from Microsoft, and Facebook which is increasingly pushing its content to users via their mobile phones.

If there is no obvious buyer, Heins does have more immediate options to add value to the business.

Heins says his most immediate concern was to sell RIM's current lineup of BlackBerry 7 touchscreen devices, deliver on a promised software upgrade for its PlayBook tablet computer by February, and rally RIM's troops to launch the next-generation BlackBerry 10 phones later this year.

Longer term, RIM could license its software or integrate its email package, a strategy that many analysts and investors have thought the company might pursue. Heins, formerly one of RIM's chief operating officers, said it would be wrong to focus on that option but he is still open to discussions.

The two men who Heins replaces together built Lazaridis' 1985 start-up into a global business. Both men, also two of RIM's three largest shareholders with more than 5 percent each, will remain board members while Lazaridis will stay on as the head of a newly created innovation committee.

"RIM have had big challenges in the past and they succeeded in moving from a corporate product to be also a consumer product, to get a foot in the consumer market and very few people expected them to do that," consultant John Strand said.

"Now they have to reinvent themselves again."
