Kahne holds off Gordon to win at Pocono Raceway

(AP) ? Kasey Kahne got the jump on Jeff Gordon off the final restart with two laps left and pulled away to win at Pocono Raceway.

Kahne had the car to beat for the final half of Sunday's 400-mile race until a late caution bunched up the field. Gordon, his Hendrick Motorsports teammate, took the lead and seemed poised to win his first race of the season. After the final caution, Kahne was strong enough this time off the restart in the No. 5 Chevrolet.

Kahne also won at Bristol this season. His win helped solidify his spot in the Chase for the Sprint Cup championship.

Gordon finished second on his 42nd birthday. Kurt Busch, Ryan Newman and Dale Earnhardt Jr. rounded out the top five.

The top five cars were Chevrolets.

Kahne, Gordon and Earnhardt made it a strong day for Hendrick. Teammate and series points leader Jimmie Johnson was 13th after a blown tire knocked him out of the lead.

Kahne had stretched his lead to almost 8 seconds when a caution for debris came out with 12 laps left. Gordon, still winless this season, was strong in the No. 24 and zipped to the lead as he looked to extend his record for career wins at Pocono.

Matt Kenseth spun with four laps left to erase Gordon's lead and set up the thrilling finish. Gordon led again until Kahne ran him down and blasted by his teammate for the win.

So close to the checkered, this loss stung Gordon.

"We had them. We certainly had the position," he said. "I'm pretty disappointed I let him get inside of me on (turn) one."

Kahne also won at Pocono in 2008. He entered ninth in the points standings and need a win to make sure he'd at least qualify for a wild-card spot should he fall below 10th place. Kahne was third last week at Indianapolis Motor Speedway and seems to be heating up with five races left until the Chase field is set.

Kahne's 16th career win should make him a Chase lock.

Gordon, who has six Pocono wins, finished second last week and has three straight top 10s to also position himself for a spot in the 12-driver field. He had won at Pocono each of the last two seasons. When Gordon leads late at Pocono, he usually wins. Just not this time.

"I've given away a lot more races than I've won," he said.

Johnson, who set a track record in qualifying, again had the dominant car for half the race until he blew a front tire. A week after a slow, final pit stop cost him a win at Indianapolis, Johnson was done in this time by a tire issue that ended his chance to win. Johnson did stretch his points lead to 77 over Clint Bowyer.

Abstract: Millions of people are exposed to arsenic in drinking water, which at high concentrations is known to cause lung cancer in humans. At lower concentrations, the risks are unknown. We enrolled 196 lung cancer cases and 359 controls matched on age and gender from western Nevada and Kings County, California in 2002?2005. After adjusting for age, sex, education, smoking and occupational exposures, odds ratios for arsenic concentrations ?85 ?g/L (median = 110 ?g/L, mean = 173 ?g/L, maximum = 1,460 ?g/L) more than 40 years before enrollment were 1.39 (95% CI = 0.55?3.53) in all subjects and 1.61 (95% CI = 0.59?4.38) in smokers. Although odds ratios were greater than 1.0, these increases may have been due to chance given the small number of subjects exposed more than 40 years before enrollment. This study, designed before research in Chile suggested arsenic-related cancer latencies of 40 years or more, illustrates the enormous sample sizes needed to identify arsenic-related health effects in low-exposure countries with mobile populations like the U.S. Nonetheless, our findings suggest that concentrations near 100 ?g/L are not associated with markedly high relative risks.

Hubble?s COSMOS survey solves ?quenched? galaxy mystery

Some galaxies hit a point in their lives when their star formation is snuffed out, and they become ?quenched.? Quenched galaxies in the distant past appear to be much smaller than the quenched galaxies in the universe today. This has always puzzled astronomers: How can these galaxies grow if they are no longer forming stars? A team of astronomers has now used a huge set of Hubble observations to give a surprisingly simple answer to this long-standing cosmic riddle.

Until now, these small snuffed-out galaxies were thought to grow into the larger quenched galaxies we see nearby.

As these galaxies are no longer forming new stars, they were thought to grow by colliding and merging with other smaller quenched galaxies some five to 10 times less massive. However, these mergers would require many such small galaxies floating around for the quenched population to snack on, which astronomers do not see.

Until recently, it had not been possible to explore a sufficient number of quenched galaxies, but now a team of astronomers has used observations from the Hubble COSMOS survey to identify and count these switched-off galaxies throughout the last 8 billion years of cosmic history.

?The apparent puffing up of quenched galaxies has been one of the biggest puzzles about galaxy evolution for many years,? said Marcella Carollo of the Federal Institute of Technology University (ETH) of Zurich, Switzerland. ?No single collection of images has been large enough to enable us to study very large numbers of galaxies in exactly the same way until Hubble?s COSMOS,? said Nick Scoville of Caltech in Pasadena, California.

The team used the large set of COSMOS images alongside additional observations from the Canada-France-Hawaii Telescope and the Subaru Telescope, both in Hawaii, to peer back to when the universe was less than half its present age. These observations mapped an area in the sky almost nine times that of the Full Moon.

The quenched galaxies seen at these times are small and compact, and, surprisingly, it seems they stay that way. Rather than puffing up and growing via mergers over time, these small galaxies mostly keep the size they had when their star formation switched off. So why do we see these galaxies apparently growing larger over time?

?We found that a large number of the bigger galaxies instead switch off at later times, joining their smaller quenched siblings and giving the mistaken impression of individual galaxy growth over time,? said Simon Lilly of ETH Zurich. ?It?s like saying that the increase in the average apartment size in a city is not due to the addition of new rooms to old buildings, but rather to the construction of new, larger apartments,? said Alvio Renzini of INAF Padua Observatory in Italy.

This tells scientists a lot about how galaxies have evolved over the last 8 billion years of the universe?s history. It was already known that actively star-forming galaxies were smaller in the early universe, explaining why they were smaller when their star formation first switched off.

?COSMOS provided us with simply the best set of observations for this sort of work. It lets us study very large numbers of galaxies in exactly the same way, which hasn?t been possible before,? said Peter Capak of Caltech. ?Our study offers a surprisingly simple and obvious explanation to this puzzle. Whenever we see simplicity in nature amidst apparent complexity, it?s very satisfying,? said Carollo.

Man arrested after crash that killed California teen model | San ...

Disturbing details have come out regarding the deadly car accident that took the life of a young model in Poway, California, last month. The collision took place early in the morning on June 20 when a car ran a red light and struck a fire truck in an intersection.

The 19-year-old passenger in the car was killed. Thursday, the driver of that vehicle was arrested. Police suspect that he was driving under the influence at the time of the crash; it has also come out that the teenager was running away from home with the man, who is 44, at the time of the collision.

It has been concluded that the teenager was intoxicated at the time of the fatal car accident. Her blood alcohol limit was about three times the legal limit, according to investigators who also say that a broken bottle of alcohol was found in the car.

The driver is now facing criminal charges for vehicular manslaughter.

As more information comes out about this case, it may also turn out that the man will face a wrongful death action.

In some cases, the loved ones of the victims of fatal car accidents choose to hold the person who is responsible liable for the death with such an action.

Of course, absolutely no amount of financial compensation can even begin to make up for the sudden loss of a teenager. Wrongful death actions can, however, help ensure that families are not unnecessarily burdened by the financial effects of fatal accidents as well as allow survivors to seek justice to the fullest extent possible.

ROUND ROCK, TEXAS / SAN FRANCISCO (Reuters) - Dell Inc's special committee and a group led by founder and Chief Executive Michael Dell are nearing a deal that dramatically increases the chances of his $24.6 billion buyout going through, two people familiar with the matter said on Friday.

The agreement, in exchange for a modification of rules for voting on the deal, would include a special dividend of 13 cents per share along with an offer increased by 10 cents per share to $13.75 per share and is expected to be announced shortly, the people said.

Dell shares were up about 5 percent at $13.60 before the opening bell.

The buyout vote, held under a new standard, would likely take place in early September, while the record date, which determines which shareholders are entitled to vote, would be reset from June 3 to sometime in August, one of the people said.

The new deal and delay in the voting date boost the buyout consortium in several ways.

Abstentions under the previous voting system counted as "no" votes, and with an estimated quarter of eligible shares not having been voted either way, that was a substantial hurdle to overcome. Under the new deal, shares that are not voted would be excluded from the tally.

A change in the record date by more than two months is also seen as enfranchising so-called arbitrage investors - hedge funds that bought Dell stock more recently to earn a few cents per share and would likely support the buyout.

Under the deal, Dell shareholders would also be entitled to three regular quarterly dividends of 8 cents per share totaling 24 cents, since the first deal with Michael Dell and Silver Lake was announced on February 5.

Dell shareholders are scheduled to convene for a third time in Round Rock, Texas, on Friday to vote on Michael Dell's original $13.65 per share buyout proposal, but this meeting will now be adjourned. The vote has already been delayed two more times, on July 18 and July 24.

Dell's founder and private equity firm Silver Lake want to take the company private, arguing that a painful restructuring can best be best performed away from stock market scrutiny.

But the battle over that deal has raged for months, adding further uncertainty about a company already shrinking along with a rapidly declining PC market.

The CEO, his advisers and proxy solicitors have gone back and forth with shareholders whose votes are needed to secure the deal. They've had some success, managing to get prominent investors such as BlackRock Inc and Vanguard onboard.

The Michael Dell-Silver Lake group said last week it would raise the offer to $13.75 per share if the voting rule was changed but the special committee rejected that offer earlier this week. The special dividend has now clinched a compromise.

Activist investor Carl Icahn, who views Michael Dell's offer of $13.65 as too low, has amassed an 8.7 percent stake in the company and is leading an opposing charge with Southeastern Asset Management Inc with an offer of their own.

Icahn has campaigned hard to get Dell to set a date for an annual shareholder meeting so he can put up his own slate of company directors.

On Thursday, he fired his latest broadside, suing Dell Inc and its board to block substantial changes to the CEO's buyout offer that would include changing the voting and record dates.

The company, created by Michael Dell in his dorm room in 1984 and which rapidly grew into a global market leader, is now a shadow of its former self.

Some investors, led by Icahn and Southeastern Asset Management, are convinced Dell still has time to transform itself as a public company into a dominant provider of business computing services.

Icahn has accused the company of resorting to "scare tactics" by disclosing bad news and dismal forecasts. Dell reported a 79 percent drop in profit for the latest quarter.

You Shouldn't Speak First When Learning Spanish

If there is only one thing I can tell you that you need to remember in order to learn Spanish or any Language at all- it is to:

Learn to LISTEN first BEFORE speaking.

Listening equals INPUT and speaking equals PRODUCTION. Let us take a factory as an example - how can a factory produce tons of products if it had no resources first and foremost? The steps they take are the same, right? They first gather resources (input) then they go into PRODUCTION. There is really no other way around.

Now that I told you about the factory; don't you think it's the same with language learning? You're just like a factory - a factory of words and vocabulary. How do you expect yourself to produce anything when you clearly have no input AT ALL? And not just that; you know what happens to a factory owner if he goes into production phase without the resources first in place? Aside from not being able to produce anything profitable, he will end up paying for overhead fees for the production and sooner or later the corporation becomes bankrupt and dies. The same goes to you, my friend; wanna die? Just kidding.

Obsessing on speaking without enough to input can lead into a disaster- you will end up being frustrated and eventually get burned out and quit. Remember that language learning is a not a "get rich quick" scheme. It involves a long road of immersion and Spanish (or any language you are learning) input acquisition. But the great news is that if you will use the correct and scientific method of language learning like the input method that we always discus; you can be sure to learn a lot FASTER than a guy who only uses only textbooks and burns himself out in classes as a beginner.

I myself took only 8 months of watching Spanish series then I found myself understanding 80% of what are being said. Spanish now sounds more or less like English for me and I now enjoy the Telenovelas and Spanish movies more than ever!

So that is what you must do for now- just watch Spanish-dubbed English shows you've seen many times in the past and I am sure after a few months you will become a real "Spaniard" just don't force yourself out for now.

So what are you waiting for? Play those telenovelas now. If you are learning German then play German drama; if you are learning French, then French - just don't stop until it makes you cry.

?Ride,? which Hunt will also produce and for which she wrote the script, is set to begin production early next week in Los Angeles.

The actress previously directed the 2007 movie ?Then She Found Me,? which starred Hunt, Colin Firth, Bette Midler, and Matthew Broderick, as well as episodes of the TV shows ?Californication? and ?Revenge.? Hunt was also recently nominated for a Best Supporting Actress Oscar for her role in the 2012 movie ?The Sessions.?

Hunt appeared in the 1986 film ?Peggy Sue Got Married? and in the 1996 movie ?Twister? with Bill Paxton as well as the 1997 film ?As Good As It Gets? with Jack Nicholson. Cancer treatment breakthrough? Scientists reveal hope for protecting patients from radiotherapy and chemotherapy

Scientists may have found a way of protecting cancer patients from the lethal effects of radiotherapy and chemotherapy using drugs that shield the sensitive gastrointestinal tract from the toxic effects of the treatment.

Strong radiation or chemotherapy can destroy metastatic cancers that have spread around the body but these aggressive treatments can end up killing patients by damaging the sensitive lining of their gut, scientists said.

A study on laboratory mice, however, has shown that two relatively simple molecules, called R-spondin1 and Slit2, bind to the guts' stem cells and in doing so protect them against the harmful side-effects of anti-cancer therapy, said Professor Jian-Guo Geng of the University of Michigan.

"All tumours from different tissues and organs can be killed by high doses of chemotherapy and radiation, but the current challenge for treating the later-staged metastasized cancer is that you actually kill the patient before you kill the tumour," Professor Geng said.

"Now you have a way to make a patient tolerate to lethal doses of chemotherapy and radiotherapy. In this way, the later-stage, metastasized cancer can be eradicated by increased doses of chemotherapy and radiation.

"It's our belief that this could eventually cure later-staged metastasized cancer. People will not die from cancer, if our prediction is true," he said.

The scientists found that between 50 per cent and 70 per cent of the mice treated in the study survived a lethal dose of chemotherapy. None of the mice that had not received the protective molecules survived the same dose.

The study, published in the journal Nature, still has a long way to go before the treatment can be tried on people, but the scientists believe that the same fundamental principles apply to human gut stem cells which ensure the absorption of nutrients and prevent the release of bacterial toxins in to the bloodstream.

"If you can keep the gut going, you can keep the patient going longer. Now we have found a way to protect the intestine. The next step is to aim for a 100-percent survival rate in mice who are injected with the molecules and receive lethal doses of chemotherapy and radiation," Professor Geng said.

Professor Owen Sansom, deputy director of Cancer Research UK's Beatson Institute, said that Professor Geng and his colleagues have made an intriguing discovery given that the toxic effect of chemo- and radio-therapy on the digestive system is one of the main reasons why doses cannot be raised to increase the chances of a cure.

"But this research was only carried out in mice, and - crucially - didn't show whether the method used would have any effects on cancer cells, which are also thought to be driven by stem cells. So, while these findings are a useful blueprint for how we could focus future effort to protect cancer patients' digestive systems, this exciting prospect is still a way off yet," Professor Sansom said.

ZaZa Energy closes sale of properties in three Eagle Ford counties

ZaZa Energy has sold off its final acreage in the Eagle Ford Shale to Sanchez Energy Corp. for nearly $30 million.

Houston-based ZaZa Energy Corp. has closed the sale of its remaining properties in the Eagle Ford Shale?s Fayette, Gonzalez and Lavaca counties to Sanchez Energy Corp., also headquartered in Houston.

The transaction includes 10,300 net acres and ZaZa?s interest in producing wells in the acreage, according to company officials.

ZaZa will net proceeds of $29.3 million after closing costs. The company will use some of the funds to reduce debt.

?This divestiture provides us with additional working capital and greater financial flexibility...,? ZaZa President and CEO Todd A. Brooks said in a written statement.

Sanford Nowlin covers energy/utilities, transportation/aviation and manufacturing.

Rihanna wins case against UK retailer Topshop

LONDON (AP) ? Pop singer Rihanna has won a court case in Britain against retailer Topshop, which was selling T-shirts bearing her image without permission.

High Court Justice Colin Birss ruled in favor of the singer on Wednesday, saying buyers were likely deceived by believing Rihanna had authorized its sale.

"I am quite satisfied that many fans of Rihanna regard her endorsement as important," the judge said in his ruling. "She is their style icon. Many will buy a product because they think she has approved of it. Others will wish to buy it because of the value of the perceived authorization itself. In both cases they will have been deceived."

Birss also said the sales caused a loss of control over Rihanna's reputation in the fashion realm, where the singer has been trying to carve out a name as a designer. She has a clothing line in her name at a rival store.

The shirts were first sold as the "Rihanna Tank." After her complaints, they were sold as being the "Headscarf Girl Tank" and the "Icon Tank."

Topshop's owner, Arcadia Group Brands Ltd., had argued that Rihanna was seeking legal recognition for a flawed assumption that only a celebrity could market a product bearing his or her image.

Topshop said it was surprised and disappointed by the ruling and was considering an appeal.

"There was no intention by Topshop to create the appearance of an endorsement or promotion," it said in a statement. "We do not believe it conveyed any false message to our customers."

The judge did not make an assessment of damages in his ruling.

Houston PE firm raises $65 million for energy deals

EIV Capital Management Co. LLC has so far raised $65 million for its second energy investment fund, regulatory filings show Tuesday.

EIV Capital Management Company LLC has so far raised $65 million for its second energy investment fund, regulatory filings show.

Officials for the firm did not immediately respond for comment.

The 4-year-old Houston private equity firm aims to provide capital to companies in the energy industry, covering a broad range of sectors, including upstream, midstream and downstream.

The firm says $5 million to $20 million deals are its sweet spot, and it focuses on energy infrastructure and production, processing, transportation, storage and other energy businesses, according to its website.

The fund, EIV Capital Fund II LP, is expected to remain open to investments for more than one year, as the first date of sale was July 15, according to a filing with the U.S. Securities and Exchange Commission.

So far, it?s collected money from 24 investors.

The biggest private equity deal this month came when Fieldwood Energy, a Houston company backed by private equity giant Riverstone Holdings LLC, took Gulf Coast assets off Apache Corp.?s (NYSE: APA) hands for $3.75 billion in cash.

Road-rage killer of 2 set for Texas execution

HUNTSVILLE ?? A former financial analyst with a history of disruptive behavior was set for execution Wednesday evening for the road-rage shooting deaths of two truckers in the Dallas area 15 years ago.

Douglas Feldman, 55, faced lethal injection for gunning down Robert Everett, 36, of Marshfield, Mo., and Nicholas Valesquez, 62, of Irving.

Feldman's attorney, Robin Norris, filed a clemency petition with the Texas Board of Pardons and Paroles that was turned down Monday. Multiple courts, including the U.S. Supreme Court, earlier rejected his appeals on Feldman's behalf.

Feldman filed to the federal courts his own appeal and a civil rights lawsuit in handwritten print. They were rejected this week as improper or without merit. He took his appeal Wednesday to the Supreme Court.

Feldman, from Richardson, was riding his motorcycle the night of Aug. 24, 1998, and said Everett, driving an 18-wheeler, cut him off on a Dallas County freeway so he took out his 9 mm pistol, pulled up alongside the truck cab and shot him. Feldman testified at his capital murder trial that he was still angry about 45 minutes later when he spotted Valesquez, a gasoline tanker driver filling a Dallas service station, and shot him.

"A security camera catches him shooting the man in cold blood," Jason January, the former Dallas County assistant district attorney who prosecuted him, said. "Several counties were frightened as this unidentified motorcyclist was out acting like 'The Terminator.'"

Feldman was arrested more than a week later, after shooting and wounding a man at a fast-food restaurant and driving off. A bystander saw the shooting and reported his license plate number to police, who tracked him down and found Feldman with two pistols and nearly 300 rounds of ammunition. Ballistics tests confirmed one of the guns was used in all three shootings.

"It feels wonderful to cause their death and to watch their pain," he said in one of 81 letters he wrote to a former girlfriend while awaiting his trial. The writings from the magna cum laude Southern Methodist University graduate were introduced into evidence.

"God forbid I ever had my finger on the button to launch a nuclear explosive device because I guarantee that I would wipe as many of these bastards off the face of the planet as I am able!" he said in another letter.

Without remorse, he also acknowledged the killings while testifying at his capital murder trial.

Evidence showed he got into trouble as a juvenile, had drug possession and selling issues and wound up in state custody. He also had robbery and drug convictions.

While in prison, records show Feldman racked up 136 disciplinary cases, including one for ripping out the phone in a visiting cage where death row inmates are interviewed by reporters. Texas prison officials subsequently refused him media access.

The day before the fatal shootings, evidence showed he shot up a Volkswagen dealership where he once had some work done.

"Obviously, Mr. Feldman was a very angry man," John Everett, who planned to witness the execution of his brother's killer, said. "I can say we looked forward to it. But it doesn't change anything. Bob is still gone."

Feldman would be the 11th prisoner executed this year in Texas and third this month. At least seven other inmates are scheduled to die in the coming months in the nation's busiest capital punishment state.

Amazon Beefing Up Fulfillment Centers With 5,000+ New Jobs


Amazon today announced plans to create more than 5,000 new full-time jobs within its U.S. fulfillment network, in an effort to meet growing consumer demand.

As the Web retail giant continues to speed delivery times and reduce shipping costs, the addition of thousands more employees means a 25 percent bump in fulfillment center staff, which currently clocks in at more than 20,000 people.

Amazon touted wages that are 30 percent higher than traditional retailers, as well as benefits, company stock awards, and bonuses. The company said it is looking for employees who can pick, pack, and ship custom orders, as well as those who have a grasp on high-end, state-of-the-art technology.

Fulfillment network jobs are currently available in 17 cities across the country. See the full list below. More details about the open positions and how to apply are available online.

"We're hiring more than 5,000 people to join our team and help us continue to innovate and serve our customers," Dave Clark, vice president of worldwide operations and customer service at Amazon, said in a statement.

The move comes the day before President Barack Obama is set to visit a company fulfillment center in Chattanooga, to speak about jobs in America, Reuters reported.

"We're focused on sustained innovation across Amazon and want to help our employees succeed ? whether at Amazon or elsewhere," Clark said. With that in mind, the company offers programs like Career Choice, which pays for up to 95 percent of eligible employees' tuition, regardless of whether their education is relevant to a career at Amazon.

Amazon is also looking to fill more than 2,000 positions ? a mix of full-time, part-time, and seasonal jobs ? in its customer service centers in Kentucky (Winchester), North Dakota (Grand Forks), Washington (Kennewick), West Virginia (Huntington).

Work-from-home positions are also available in Oregon, Washington, and Arizona.

Saar: Freeing Terrorists in Israel's Interest

Freeing terrorists with blood on their hands will ultimately be in Israel?s favor, Minister of the Interior Gidon Saar argued Sunday, as the government prepared to vote on a plan to free over 100 prisoners as a "gesture" to the Palestinian Authority.

?It?s easy and populist to vote ?no? ? but what would happen if all of us, or even half of us, voted ?no??? he asked.

He answered himself, ?A vote against would mean the government of Israel rejects the agreement that the Prime Minister made with the American Secretary of State. The negotiations would not open. Israel would be blamed ? even by its best friends ? for the fact that they did not open.?

Israel must be cautious, Saar warned. ?Our position in the international system is not a simple one, to put it mildly. We are likely to deteriorate quickly, in a manner that would have a severe impact on our national interests,? he argued.

?To clarify, these national interests include our ability to insist on defensible borders,? he added.

The Palestinian Authority wanted three main things from Israel in advance of talks, Saar said: the release of terrorist prisoners, a full ban on construction in Israeli towns east of the 1949 armistice line, and an agreement that territorial negotiations would be based on the 1949 armistice line.

Netanyahu made a strategic choice, he said. ?If you look at the main reason we have been dealing with diplomatic difficulties since the former government was established in 2009, it is our unwillingness ? which has not changed ? to accept the ?67 lines as a basis for talks? The Prime Minister was tested in this matter, it was not easy ? including opposite the President of the United States? This is a central strategic issue,? he explained.

?I think that it would have been very hard to stand our ground regarding settlements, too,? he continued. ?If we had given in on the matter of settlements, we would have earned more points with the international community. Our refusal to release prisoners would have been accepted in those circumstances.?

?But that would be a more dangerous concession,? he warned. ?That would have been giving our stamp of approval to delegitimizing the settlement enterprise, and it would have extra meaning coming immediately after the European Union?s latest decision.?

?Today, the members of government face two bad choices: to vote for, or vote against. I believe that a vote against is a decision that would do far more damage than a vote for,? he concluded.

Significant opposition

Despite Saar's insistence, not all members of the government?are convinced that the release is a good thing, to put it mildly.

Bayit Yehudi (Jewish Home) MK and Knesset faction chairwoman?Ayelet?Shaked slammed the move as a "surrender to the Americans" on?Sunday.

Speaking at a rally opposing the release of terrorists, Shaked accused the government of forgetting "why we are here and?how to?stay here. It started with giving in to terror in the Shalit deal and continues with surrendering to the Americans. For what?? She added that although Israeli agent Jonathan Pollard killed no one, and shed no blood, he is still sitting in a prison, decades later, despite appeals even from the prime minister himself.

Bayit Yehudi leader and Minister of Economy?Naftali?Bennett?has said that he strongly opposes the move and will vote against it when it is brought up for a vote at the cabinet.

Just a day after kidnapper Ariel Castro plead guilty, one of the three women held captive in his home for a decade made an appearance at a concert. TODAY's Jenna Wolfe reports.

One of three women held captive in a Cleveland home for a decade appeared at a public event for the first time since her rescue, a day after her abductor pleaded guilty in the case.

Amanda Berry made a surprise appearance at the daylong concert RoverFest in Cleveland on Saturday night, walking on stage with her family and waving at the cheering crowd. Wearing sunglasses and dressed in jeans and a black T-shirt, Berry smiled broadly while acknowledging the applause, but she didn't address the crowd. The rapper Nelly called Berry back to the stage after his music set.

The appearance came a day after Ariel Castro, a former school bus driver, pleaded guilty to 937 counts in a deal that will send him to prison for life without parole, plus 1,000 years.

Berry, now 27, Gina DeJesus and Michelle Knight disappeared between 2002 and 2004 when they were 14, 16 and 20 years old. They escaped in May when Berry kicked out part of a door and called to neighbors for help.

Berry told a police dispatcher in a dramatic 911 call: "Help me. I'm Amanda Berry. I've been kidnapped, and I've been missing for 10 years, and I'm, I'm here, I'm free now."

Castro, 53, who was arrested and jailed shortly afterward, was accused of raping and beating the three repeatedly. He also fathered a 6-year-old daughter with Berry, authorities say.

The women didn't attend the court proceeding but said in a statement that they were relieved by the conviction and looking forward to the end of the legal proceedings.

Berry and the other women said she had accepted a ride from Castro, who had remained friends with DeJesus' family and attended vigils over the years marking her disappearance.

Castro was accused of restraining the women, sometimes chaining them to a pole in a basement, to a bedroom heater or inside a van. The indictment included two counts of aggravated murder related to accusations that he punched and starved one of the women until she miscarried.

Earlier this month, the three women offered thanks on YouTube for emotional and financial backing they've received since going "through hell and back."

New Discovery may Individualise Cancer Treatment


The research, published online today in Science, "increases understanding of the molecular mechanisms of action of PTEN, which is known to be defective in as many as half of all advanced cancers" says principal investigator Vuk Stambolic, Senior Scientist at the Princess Margaret Cancer Centre. Dr. Stambolic, a specialist in cell signalling, is also an Associate Professor in the Department of Medical Biophysics, University of Toronto.

In the lab, working with cell and animal models of cancer, the research team discovered what happens when the protein product of PTEN is lost or deregulated. Dr. Stambolic says: "We realized that the PTEN nuclear function links this tumor suppressor to the response to conventional cancer treatments, such as chemotherapy or radiation. This new knowledge, combined with our prior understanding of PTEN, provided immediate clues for individualizing therapy for patients with PTEN-deficient tumors."

Medical oncologist Lillian Siu, who leads numerous clinical trials at Princess Margaret, but was not directly involved in this research, says: "For clinicians, this is a significant finding that could help guide treatment decisions, especially considering that we can already test for PTEN deficiency by molecularly analyzing biopsied tissue, providing a biomarker for implementation of combined therapies that may be most effective."

For Dr. Stambolic, the discovery builds on his earlier research (Cell, 1998) which helped explain how PTEN loss promotes cell survival, another key feature of cancerous cells. "We now realize that the PTEN story was only half-told in 1998," says Dr. Stambolic. "The new findings, in conjunction with advances in molecular profiling and access to drugs already available or being tested in clinical development, present a tangible scenario to tailor treatment."

Ehh, I might consider that but with travel VZW is really the only practical option.

Also, I think rooting/flashing is much less an issue these days. I ran my Rezound with the stock Sense for over 6 months with no problems. The Android updates, at this point, are pretty marginal. The bloatware is easily out-of-sight, out-of-mind. I don't even anticipate upgrading my phone for another year or two.

I sympathize with your feelings, but I don't feel anyone else has national service on par with VZW to make leaving viable.

The surgery has taken its toll on Lanz. After removing part of his lower tibula to replace parts of his jaw and cutting out part of his tongue, he has a hard time speaking and walking. Lanz has had to return to the hospital every week in order to repair skin grafts and monitor his condition.

After losing his job as a press operator at the Oneida Daily Dispatch in 2011 due to press operations moving to Syracuse, Lanz has been on and off unemployment due to his medical condition. Finally in August, Lanz found a job working through a temporary employment agency in Oneida. He was hired full-time at the Hood facility in Vernon in November. Because of the short duration of his employment, he has been unable to receive disability for his surgery and inability to work during recovery.

To make matters worse, while Lanz was in the hospital after his surgery, his home was seriously damaged during the June 28 flood. Lanz, along with his daughter Emilee and wife Ronda, have been living in the Days Inn in Canastota for almost a month. They are not sure how much longer they can continue to live outside of their home.

Meanwhile, Emilee is on her way to Herkimer Community College, a process that was severely dampened when flood waters destroyed some of the necessary paperwork for her enrollment. She may not be able to go to school until the spring semester in January. Her graduation party, scheduled to take place at their home on Stoddard Street, was cancelled; however, the family is thankful for the Oneida American Legion, which hosted the event and helped with most of its costs, the rest donated by family and friends.

The family is currently living off donations from family, friends, Hood, the small savings they have left and the small salary their son Eric makes working for Ralston?s Party Supply. Lanz said he will have to undergo at least six months of recovery, but that process may be significantly longer due to radiation therapy.

?After everything and therapy, I?m not sure I?ll be able to stand for my eight hour shifts,? Lanz said, pointing to the skin graft on his leg covering the partial tibula. He said it will depend on his physical therapy results whether he may be able to work again.

Lanz and his wife Ronda said they are extremely grateful for everything people have done to help them, though they are not sure how they will continue to afford medical costs and the repair costs for their home. With both of their children hopefully going to college in the fall, they plan to get electricity restored to their home and live in the upstairs until they can get the first floor repaired; however, Ronda said she?safraid the stairs may be impassible for Terrie. They are waiting on state aid to see if they can begin repairing their home.

Lanz? family has set up a benefit to not only help with his medical costs, but aid the family in housing repairs and costs. The benefit will take place Aug. 17 at Jack?s or Better on Lake Road in Oneida at 1 p.m. The family will host basket raffles, food, live music and a 50/50 raffle. Entrance is $10 per person, kids under 12 get in for free. Tickets are available by calling 761-9681, 264-5269 or at Jack?s or Better.

Ashton Kutcher and director break down 'Jobs,' talk man behind the curtain

"It only takes one person to start a revolution," and after a special screening of the Jobs biopic, it's evident that Ashton Kutcher, the actor portraying the iconic Apple founder, believes in the credo.

On Thursday, film studio Open Road invited the press to a pre-release screening of Jobs in San Francisco. The film will open in U.S. theaters Aug. 16.

While we can't divulge on the film, a post-credits Q&A with direct Joshua Michael Stern and Kutcher gave us plenty of writing fodder.

The theater was packed with press and rather annoyingly, many had Google Glass in tow.

However, sporting the gaudy gear seemed appropriate for a film about the limitless boundaries of innovation, where during the question and answer session Kutcher eloquently addressed the importance of failing, and the need to encourage entrepreneurs in the breakneck world of tech.

Dissecting Jobs

Jobs' life was filled with troublesome relationships caused by his "prickly personality," which is putting it rather mildly.

Stern addressed how Jobs never lived in the past, rather relying on the present and focusing on future endeavors. For Stern, Jobs was loyal to his achievements first, and that required boxed up emotions and a lack of sentimentality.

When asked what his thoughts were on Jobs' mercurial cruelty, Kutcher explained that after much research, he believed the continued rejection in Jobs' life from his parents, people around him and the betrayal from his own company played a huge role in creating the famous, dysfunctional personality.

Kutcher said the result of Jobs' erratic, anti-social tendencies only pushed him harder to create products that people would love - because in loving the product, they essentially love its creator, an emotional process that Kutcher described as "very human."

The baseball hat-donned actor also added that despite Jobs' genius, there's clearly a kinder way to treat employees, and people in general - reassuring since Kutcher himself co-founded a media company and created a venture capital fund.

When asked about the type of preparations he took on for the role, the infamous Steve Jobs gait was brought up.

With three months to prep, Kutcher said he tried to digest all of the books Jobs read (Edison, Ansel Adams, etc.), while researching Bauhaus and numerous other design concepts.

He even had hours of Jobs audio on a Soundcloud full of speeches he'd listen to while driving or walking, and even fall asleep to, in order to get the perplexing role right.

Because Jobs often liked to be outside walking and hiking, and even having meetings in the fresh air, Kutcher did the same - which is when he would practice the peculiar hunched hop Jobs was known for.

Kutcher had his own speculations about this particular walking style. He felt Jobs' barefoot days in the 70s during college made him lift his feet higher to avoid stubbing his toes, a step he then simply carried on for the rest of his life.

The dedication of Kutcher's research to show us the man behind the curtain seems quite obsessive in nature (heck, it even put him in the hospital as reported earlier this year), and interestingly, provides another parallel to Jobs' own obsessive personality.

Personality and mop-top makeup aside, the tall bean-pole actor shares other similarities with Jobs: the ability to convey idealistic soliloquies with extreme passion as if his life depended on it.

Though his topics of discussion almost sounded like a valedictorian speech, Kutcher still won over the audience by expressing what appeared like genuine, articulate thoughts on the need for more never-give-up type of entrepreneurs in the tech sphere:

"We need entrepreneurs more than ever ? the great innovation that happens in the world is happening around technology ? we're doing an incredible job leading the world - the United States is building technology and we need to inspire people."

It seems like he's taking a page right of Jobs' book with his desire to tell others to rise up and be more, and to be better. Kutcher's zeal for tech is so transparent, he went on to mention Elon Musk or even one of the entrepreneurs he works with every day as being the next "god" to revolutionize tech.

Regardless of who it is, Kutcher adamantly stated that the formula for the next Jobs will require someone who is "driven, focused and works hard and fearlessly approaches failure, and falls down and gets back up."

For Kutcher, failing repeatedly will birth the next great pioneer in technology: "I guarantee you the next person who innovates that way will be someone who's failed many times in their lifetime."

Inaccuracies, schminaccuracies

Thought a lot more was said (as if there wasn't enough here already) about the portrayal of the iconic Apple founder, one issue raised were the discrepancies with reality present in the film.

Steve Wozniak has been vocal about this by telling Gizmodo how it was actually him trying to convince Jobs about the democratization of technology - Jobs apparently only wanted to make a quick buck and his lofty speeches seen in the trailers, "came much further down the line."

However, Stern claims Jobs always had an aura of mystery that no one could or would be able to unravel and that the film wasn't an exact science in terms of real events, but was as close as the filmmakers could get.

For Kutcher, near-perfect authenticity was also important, evident in his countless hours of research. But what mattered most to him occurred after a private screening held for the original Apple gang - a member strode up to Kutcher and said, "Thank you for giving me back two hours with Steve."

And really, that's all we can hope from the film.
