Google emerges from FTC probe relatively unscathed

(AP) ? Google has settled a U.S. government probe into its business practices without making any major concessions on how the company runs its Internet search engine, the world's most influential gateway to digital information and commerce.

Thursday's agreement with the Federal Trade Commission covers only some of the issues raised in a wide-ranging antitrust investigation that could have culminated in a regulatory crackdown that re-shapes Internet search, advertising and mobile computing.

But the FTC didn't find any reason to impose radical changes, to the relief of Google and technology trade groups worried about overzealous regulation discouraging future innovation. The resolution disappointed consumer rights groups and Google rivals such as Microsoft Corp., which had lodged complaints with regulators in hopes of legal action that would split up or at least hobble the Internet's most powerful company.

Google is still trying to settle a similar antitrust probe in Europe. A resolution to that case is expected to come within the next few weeks.

After a 19-month investigation, Google Inc. placated the FTC by agreeing to a consent decree that will require the company to charge "fair, reasonable and non-discriminatory" prices to license hundreds of patents deemed essential to the operations of mobile phones, tablet computers, laptops and video game players.

The requirement is meant to ensure that Google doesn't use patents acquired in last year's $12.4 billion purchase of Motorola Mobility to thwart competition from mobile devices running on software other than Google's Android system. The products vying against Android include Apple Inc.'s iPhone and iPad, Research in Motion Ltd.'s BlackBerry and Microsoft's Windows software.

Google also promised to exclude, upon request, snippets copied from other websites in capsules of key information shown in response to search requests. The company had insisted the practice is legal under the fair-use provisions of U.S. copyright law. Nonetheless, even before the settlement, Google already had scaled back on the amount of cribbing, or "scraping," of online content after business review site Yelp Inc. lodged one of the complaints that triggered the FTC investigation in 2011.

In another concession, Google pledged to adjust the online advertising system that generates most of its revenue so marketing campaigns can be more easily managed on rival networks.

Google, though, prevailed in the pivotal part of the investigation, which delved into complaints that the Internet search leader has been highlighting its own services on its influential results page while burying links to competing sites. For instance, requests for directions may turn up Google Maps first, queries for video might point to the company's own site, YouTube, and searches for merchandise might route users to Google Shopping.

Although the FTC said it uncovered some obvious instances of bias in Google's results during the investigation, the agency's five commissioners unanimously concluded there wasn't enough evidence to take legal action.

"Undoubtedly, Google took aggressive actions to gain advantage over rival search providers," said Beth Wilkinson, a former federal prosecutor that the FTC hired to help steer the investigation. "However, the FTC's mission is to protect competition, and not individual competitors."

Two consumer rights groups lashed out at the FTC for letting Google off too easily.

"The FTC had a long list of grievances against Google to choose from when deciding if they unfairly used their dominance to crush their competitors, yet they failed to use their authority for the betterment of the marketplace," said Steve Pociask, president of the American Consumer Institute.

John Simpson of frequent Google critic Consumer Watchdog asserted: "The FTC rolled over for Google."

David Wales, who was the FTC's antitrust enforcement chief in 2008 and early 2009, said the agency had to balance its desire to prevent a powerful company from trampling the competition against the difficulty of proving wrongdoing in a rapidly changing Internet search market.

"This is a product of the FTC wanting to push the envelope of antitrust enforcement without risking the danger of losing a case in in court," said Wales, who wasn't involved with the case and is now a partner at the law firm Jones Day.

FTC Chairman Jon Leibowitz said the outcome "is good for consumers, it is good for competition, it is good for innovation and it is the right thing to do." Before reaching its conclusion, the FTC reviewed more than 9 million pages of documents submitted by Google and its rivals and grilled top Internet industry executives during sworn depositions.

The Computer & Communications Industry Association, a technology trade group, applauded the FTC for its handling of the high-profile case.

"This was a prudent decision by the FTC that shows that antitrust enforcement, in the hands of responsible regulators, is sufficiently adaptable to the realities of the Internet age," said Ed Black, the group's president.

The FTC has previously been criticized for not doing more to curb Google's power. Most notably, the FTC signed off on Google's $3.2 billion purchase of online advertising service DoubleClick in 2008 and its $681 million acquisition of mobile ad service AdMob in 2010. Google critics contend those deals gave the company too much control over the pricing of digital ads, which account for the bulk of Google's revenue.

If Google breaks any part of the agreement, Leibowitz said the FTC can fine the company up to $16,000 per violation. Last year, the FTC determined that Google broke an agreement governing Internet privacy, resulting in a $22.5 million fine, though the company didn't acknowledge any wrongdoing.

Google's ability to protect its search recipe from government-imposed changes represents a major victory for a company that has always tried to portray itself as force for good. The Mountain View, Calif., company has portrayed its dominant search engine as a free service that is constantly tweaking its formula so that people get the information they desire more quickly and concisely.

"The conclusion is clear: Google's services are good for users and good for competition," David Drummond, Google's top lawyer, wrote in a Thursday blog post.

Google's tactics also have been extremely lucrative. Although Google has branched into smartphones and many other fields since its founding in a Silicon Valley garage in 1998, Internet search and advertising remains its financial backbone. The intertwined services still generate more than 90 percent of Google's revenue, which now exceeds $50 billion annually.

Throughout the FTC investigation, Google executives also sought to debunk the notion that the company's recommendations are the final word on the Internet. They pointed out that consumers easily could go to Microsoft's Bing, Yahoo or other services to search for information. "Competition is just a click away," became as much of a Google mantra as the company's official motto: "Don't be evil."

Microsoft cast the FTC's investigation as a missed opportunity.

"The FTC's overall resolution of this matter is weak and ? frankly ?unusual," Dave Heiner, Microsoft's deputy general counsel, wrote on the company's blog. "We are concerned that the FTC may not have obtained adequate relief even on the few subjects that Google has agreed to address."

FairSearch, a group whose membership includes Microsoft, called the FTC's settlement "disappointing and premature," given that European regulators might be able to force Google to make more extensive changes.

"The FTC's inaction on the core question of search bias will only embolden Google to act more aggressively to misuse its monopoly power to harm other innovators," FairSearch asserted.

Yelp also criticized the FTC's handling of the case, calling "it a missed opportunity to protect innovation in the Internet economy, and the consumers and businesses that rely upon it."

Investors had already been anticipating Google would emerge from the inquiry relatively unscathed.

Google's stock rose 42 cents Thursday to close at $723.67. Microsoft, which is based in Redmond, Wash., shed 37 cents, or 1.3 percent, to finish at $27.25.

In a research note Thursday, Macquarie Securities analyst Benjamin Schachter described the settlement as "the best possible outcome" for Google. "We believe that the terms of the agreement will have very limited negative financial or strategic implications for the company." Schachter wrote.

Cognitive difficulties associated with menopause described

Jan. 3, 2013 ? The memory problems that many women experience in their 40s and 50s as they approach and go through menopause are both real and appear to be most acute during the early period of post menopause. That is the conclusion of a study which appears January 3 in the journal Menopause.

"Women going through menopausal transition have long complained of cognitive difficulties such as keeping track of information and struggling with mental tasks that would have otherwise been routine," said Miriam Weber, Ph.D. a neuropsychologist at the University of Rochester Medical Center (URMC) and lead author of the study. "This study suggests that these problems not only exist but become most evident in women in the first year following their final menstrual period."

The study followed 117 women, who were grouped into categories based on criteria established in 2011 by the Stages of Reproductive Aging Workshop +10, which consisted of an international consortium of researchers.

Study participants took a variety of tests assessing their cognitive skills, reported on menopause-related symptoms such as hot-flashes, sleep disturbance, depression and anxiety, and gave a sample of blood to determine current levels of estradiol (an indicator of estrogen levels) and follicle stimulating hormone. Results were analyzed to determine if there were group differences in cognitive performance, and if these differences were due to menopausal symptoms.

The study grouped participants into four stages: late reproductive, early and late menopausal transition, and early post menopause. The late reproductive period is defined as when women first begin to notice subtle changes in their menstrual periods, such as changes in flow amount or duration, but still have regular menstrual cycles.

Women in the transitional stage experience greater fluctuation in menstrual cycles -- from a difference of 7 days or more in the early phase of transition to 60 days or longer in the later phase. Hormone levels also begin to fluctuate significantly during this time. This transition period can last for several years.

The researchers also evaluated women in early post menopause, defined as the first year after which a woman experienced her last menstrual period.

The study participants were assessed with a comprehensive battery of tests to evaluate a variety of cognitive skills. These included tests of attention, verbal learning and memory, fine motor skills and dexterity, and "working memory" -- or the ability to not only take in and store new information, but also manipulate it.

These tests are similar to daily tasks such as staying focused on something for a period of time, learning a new telephone number, and making a mental list of groceries and then recalling specific items as required as one wanders the aisles of a grocery store.

The researchers found that women in the early stage of post menopause performed worse on measures of verbal learning, verbal memory and fine motor skill than women in the late reproductive and late transition stages.

The researchers also found that self-reported symptoms such as sleep difficulties, depression, and anxiety did not predict memory problems. Nor could these problems be associated with specific changes in hormone levels found in the blood.

"These findings suggest that cognitive declines through the transition period are independent processes rather than a consequence of sleep disruption or depression," said Weber. "While absolute hormone levels could not be linked with cognitive function, it is possible that the fluctuations that occur during this time could play a role in the memory problems that many women experience."

The process of learning new information, holding on to it, and employing it are functions associated with regions of the brain known as the hippocampus and prefrontal cortex. These parts of the brain are rich with estrogen receptors.

"By identifying how these memory problems progress and when women are most vulnerable, we now understand the window of opportunity during which interventions -- be those therapeutic or lifestyle changes -- may be beneficial," said Weber. "But the most important thing that women need to be reassured of is that these problems, while frustrating, are normal and, in all likelihood, temporary."

(AP) ? The United Nations gave a grim new count Wednesday of the human cost of Syria's civil war, saying the death toll has exceeded 60,000 in 21 months ? far higher than recent estimates by anti-regime activists.

The day's events illustrated the escalating violence that has made recent months the deadliest of the conflict: As rebels pressed a strategy of attacking airports and pushing the fight closer to President Bashar Assad's stronghold in Damascus, the government responded with deadly airstrikes on restive areas around the capital.

A missile from a fighter jet hit a gas station in the suburb of Mleiha, killing or wounding dozens of people who were trapped in burning piles of debris, activists said.

Gruesome online video showed incinerated victims ? one still sitting astride a motorcycle ? or bodies torn apart.

"He's burning! The guy is burning!" an off-camera voice screamed in one video over a flaming corpse.

It was unclear if the government had a military strategy for attacking the gas station. At least one of the wounded wore a military-style vest often used by rebel fighters. Human rights groups and anti-regime activists say Assad's forces often make little effort to avoid civilian casualties when bombing rebel areas.

Syria's conflict began in March 2011 with protests calling for political change but has evolved into a full-scale civil war.

As the rebels have grown more organized and effective, seizing territory in the north and establishing footholds around Damascus, the government has stepped up its use of airpower, launching daily airstrikes. The escalating violence has sent the death toll soaring.

The U.N.'s new count of more than 60,000 deaths since the start of the conflict is a third higher than recent estimates by anti-regime activists. One group, the Britain-based Syrian Observatory for Human Rights, says more than 45,000 people have been killed. Other groups have given similar tolls.

"The number of casualties is much higher than we expected, and is truly shocking," U.N. High Commissioner for Human Rights Navi Pillay said in a statement.

She criticized the government for inflaming the conflict by cracking down on peaceful protests and said rebel groups, too, have killed unjustifiably. Acts by both sides could be considered war crimes, she said.

She also faulted world powers for not finding a way to stop the violence.

"The failure of the international community, in particular the Security Council, to take concrete actions to stop the bloodletting shames us all," Pillay said. "Collectively, we have fiddled at the edges while Syria burns."

The U.S. and many European and Arab nations have demanded that Assad step down, while Russia, China and Iran have criticized calls for regime change.

The new death toll was compiled by independent experts commissioned by the U.N. human rights office who compared 147,349 killings reported by seven different sources, including the Syrian government.

After removing duplicates, they had a list of 59,648 individuals killed between the start of the uprising on March 15, 2011, and Nov. 30, 2012. In each case, the victim's first and last name and the date and location of death were known. Killings in December pushed the number past 60,000, she said.

The total death toll is likely to be even higher because incomplete reports were excluded, and some killing may not have been documented at all.

"There are many names not on the list for people who were quietly shot in the woods," Pillay's spokesman Rupert Colville told The Associated Press.

The data did not distinguish among soldiers, rebels or civilians.

It indicated that the pace of killing has accelerated. Monthly death tolls in summer 2011 were around 1,000. A year later, they had reached about 5,000 per month.

Most of the killings were in the province of Homs, followed by the Damascus suburbs, Idlib, Aleppo, Daraa and Hama. At least three-fourths of the victims were male.

Pillay warned that thousands more could die or be injured, and she said the danger could continue even after the war.

"We must not compound the existing disaster by failing to prepare for the inevitable ? and very dangerous ? instability that will occur when the conflict ends," she said.

The U.N. refugee agency said about 84,000 people fled Syria in December alone, bringing the total number of refugees to about a half-million. Many more are displaced inside Syria.

While no one expects the war to end soon, international sanctions and rebel advances are eroding Assad's power. Rebels recently have targeted two pillars of his strength: his control of the skies and his grip on Damascus.

Rebels in northern Syria attacked a government helicopter base near the village of Taftanaz in Idlib province, activists said. Videos posted online showed them blasting targets inside the airport with heavy machine guns mounted on trucks.

All videos appeared genuine and corresponded with other AP reporting on the events.

In recent weeks, rebels have attacked three other airports in north Syria. They clashed Wednesday with forces inside the Mannagh military airport near the Turkish border as well as near the Aleppo international airport and adjacent Nerab military airport, halting air traffic there for the second straight day.

The fall of those airports to the rebels would embarrass the regime but not fully stop the airstrikes by government jets, many of which come from bases farther south.

In another blow to the regime and to Syria's economy, a company based in the Philippines that handled shipping containers at Syria's largest port said it was canceling its contract, citing an "untenable, hostile and dangerous business environment."

The Manila-based International Container Terminal Services Inc. said the amount of port traffic had gone down, hurting business, while conditions in Syria grew more dangerous.

The company's departure will significantly limit cargo services at the Tartus port.

Also, Wednesday, the family of American journalist James Foley revealed that he has been missing in Syria for more than a month. Foley was providing video for Agence France-Press when he was abducted Nov. 22 by unknown gunmen, his family said in a statement.

"His captors, whoever they may be, must release him immediately," said AFP chairman Emmanuel Hoog.

Covering Syria has been a challenge for journalists. The government rarely gives visas to journalists, prompting some to sneak in with the rebels, often at great danger.
