Road-rage killer of 2 set for Texas execution

HUNTSVILLE ?? A former financial analyst with a history of disruptive behavior was set for execution Wednesday evening for the road-rage shooting deaths of two truckers in the Dallas area 15 years ago.

Douglas Feldman, 55, faced lethal injection for gunning down Robert Everett, 36, of Marshfield, Mo., and Nicholas Valesquez, 62, of Irving.

Feldman's attorney, Robin Norris, filed a clemency petition with the Texas Board of Pardons and Paroles that was turned down Monday. Multiple courts, including the U.S. Supreme Court, earlier rejected his appeals on Feldman's behalf.

Feldman filed to the federal courts his own appeal and a civil rights lawsuit in handwritten print. They were rejected this week as improper or without merit. He took his appeal Wednesday to the Supreme Court.

Feldman, from Richardson, was riding his motorcycle the night of Aug. 24, 1998, and said Everett, driving an 18-wheeler, cut him off on a Dallas County freeway so he took out his 9 mm pistol, pulled up alongside the truck cab and shot him. Feldman testified at his capital murder trial that he was still angry about 45 minutes later when he spotted Valesquez, a gasoline tanker driver filling a Dallas service station, and shot him.

"A security camera catches him shooting the man in cold blood," Jason January, the former Dallas County assistant district attorney who prosecuted him, said. "Several counties were frightened as this unidentified motorcyclist was out acting like 'The Terminator.'"

Feldman was arrested more than a week later, after shooting and wounding a man at a fast-food restaurant and driving off. A bystander saw the shooting and reported his license plate number to police, who tracked him down and found Feldman with two pistols and nearly 300 rounds of ammunition. Ballistics tests confirmed one of the guns was used in all three shootings.

"It feels wonderful to cause their death and to watch their pain," he said in one of 81 letters he wrote to a former girlfriend while awaiting his trial. The writings from the magna cum laude Southern Methodist University graduate were introduced into evidence.

Below is a 1999 News 8 story reported by former investigative reporter Robert Riggs:

"God forbid I ever had my finger on the button to launch a nuclear explosive device because I guarantee that I would wipe as many of these bastards off the face of the planet as I am able!" he said in another letter.

Without remorse, he also acknowledged the killings while testifying at his capital murder trial.

Evidence showed he got into trouble as a juvenile, had drug possession and selling issues and wound up in state custody. He also had robbery and drug convictions.

While in prison, records show Feldman racked up 136 disciplinary cases, including one for ripping out the phone in a visiting cage where death row inmates are interviewed by reporters. Texas prison officials subsequently refused him media access.

The day before the fatal shootings, evidence showed he shot up a Volkswagen dealership where he once had some work done.

"Obviously, Mr. Feldman was a very angry man," John Everett, who planned to witness the execution of his brother's killer, said. "I can say we looked forward to it. But it doesn't change anything. Bob is still gone."

Feldman would be the 11th prisoner executed this year in Texas and third this month. At least seven other inmates are scheduled to die in the coming months in the nation's busiest capital punishment state.

97% The Act Of Killing

All Critics (65) | Top Critics (17) | Fresh (63) | Rotten (2)

Oppenheimer allows murderous thugs free rein to preen their atrocities, and then fobs it all off as some kind of exalted art thing. This is more than an aesthetic crime; it's a moral crime.

Whatever you call it, The Act of Killing is a must-see.

It's a mind-bending film, devastating and disorienting, that disturbs us in ways we're not used to being disturbed ...

[It] may be one of the most horrifying films you'll ever see, and one of the most edifying.

It will leave you breathless.

It's a virtually unprecedented social document.

Anwar Congo may be the scariest person you'll see on screen this year.

If director Joshua Oppenheimer occasionally loses his way in his own narrative, where this picture demands attention is in its chilling portrait of indoctrination and evil.

It's a gut-wrenching and emotionally exhausting look at impunity that resonates far beyond its obscure central conflict.

A cynically exploitative film made in the name of human rights, which it has about as much to do with as the Punked show on MTV.

Presenting a terrifying view of a hidden holocaust and a moral apocalypse in which the most basic humanities have become twisted beyond recognition, The Act of Killing is a towering achievement in filmmaking, documentary or otherwise.

The magnitude of this achievement, this depiction of a diseased and corrupt society that is in so many ways similar to our own, cannot be understated.

I have watched hundreds of hours of war crimes, genocides and miscarriages of justice carried out by unremarkable men with dimly lit souls. "The Act of Killing" bids to outdo them all.

Atrocity hides beneath a grandfather's gentle smile in "The Act of Killing," Joshua Oppenheimer's remarkable, unnerving documentary portrait of barbarity and its lasting legacies.

As filming continues, the quiet brilliance behind the assignment comes to light.

Ultimately, The Act Of Killing acknowledges that while Oppenheimer may have subtly tortured their conscience, these thugs are paying no real price.

Prepare to be shocked, disgusted, enraged and emotionally devastated. It's the most terrifying film in years.

Amazon Beefing Up Fulfillment Centers With 5,000+ New Jobs

Amazon today announced plans to create more than 5,000 new full-time jobs within its U.S. fulfillment network, in an effort to meet growing consumer demand.

As the Web retail giant continues to speed delivery times and reduce shipping costs, the addition of thousands more employees means a 25 percent bump in fulfillment center staff, which currently clocks in at more than 20,000 people.

Amazon touted wages that are 30 percent higher than traditional retailers, as well as benefits, company stock awards, and bonuses. The company said it is looking for employees who can pick, pack, and ship custom orders, as well as those who have a grasp on high-end, state-of-the-art technology.

Fulfillment network jobs are currently available in 17 cities across the country. See the full list below. More details about the open positions and how to apply are available online.

"We're hiring more than 5,000 people to join our team and help us continue to innovate and serve our customers," Dave Clark, vice president of worldwide operations and customer service at Amazon, said in a statement.

The move comes the day before President Barack Obama is set to visit a company fulfillment center in Chattanooga, to speak about jobs in America, Reuters reported.

"We're focused on sustained innovation across Amazon and want to help our employees succeed ? whether at Amazon or elsewhere," Clark said. With that in mind, the company offers programs like Career Choice, which pays for up to 95 percent of eligible employees' tuition, regardless of whether their education is relevant to a career at Amazon.

Amazon is also looking to fill more than 2,000 positions ? a mix of full-time, part-time, and seasonal jobs ? in its customer service centers in Kentucky (Winchester), North Dakota (Grand Forks), Washington (Kennewick), West Virginia (Huntington).

Work-from-home positions are also available in Oregon, Washington, and Arizona.

Saar: Freeing Terrorists in Israel's Interest

Freeing terrorists with blood on their hands will ultimately be in Israel?s favor, Minister of the Interior Gidon Saar argued Sunday, as the government prepared to vote on a plan to free over 100 prisoners as a "gesture" to the Palestinian Authority.

?It?s easy and populist to vote ?no? ? but what would happen if all of us, or even half of us, voted ?no??? he asked.

He answered himself, ?A vote against would mean the government of Israel rejects the agreement that the Prime Minister made with the American Secretary of State. The negotiations would not open. Israel would be blamed ? even by its best friends ? for the fact that they did not open.?

Israel must be cautious, Saar warned. ?Our position in the international system is not a simple one, to put it mildly. We are likely to deteriorate quickly, in a manner that would have a severe impact on our national interests,? he argued.

?To clarify, these national interests include our ability to insist on defensible borders,? he added.

The Palestinian Authority wanted three main things from Israel in advance of talks, Saar said: the release of terrorist prisoners, a full ban on construction in Israeli towns east of the 1949 armistice line, and an agreement that territorial negotiations would be based on the 1949 armistice line.

Netanyahu made a strategic choice, he said. ?If you look at the main reason we have been dealing with diplomatic difficulties since the former government was established in 2009, it is our unwillingness ? which has not changed ? to accept the ?67 lines as a basis for talks? The Prime Minister was tested in this matter, it was not easy ? including opposite the President of the United States? This is a central strategic issue,? he explained.

?I think that it would have been very hard to stand our ground regarding settlements, too,? he continued. ?If we had given in on the matter of settlements, we would have earned more points with the international community. Our refusal to release prisoners would have been accepted in those circumstances.?

?But that would be a more dangerous concession,? he warned. ?That would have been giving our stamp of approval to delegitimizing the settlement enterprise, and it would have extra meaning coming immediately after the European Union?s latest decision.?

?Today, the members of government face two bad choices: to vote for, or vote against. I believe that a vote against is a decision that would do far more damage than a vote for,? he concluded.

Significant opposition

Despite Saar's insistence, not all members of the government?are convinced that the release is a good thing, to put it mildly.

Bayit Yehudi (Jewish Home) MK and Knesset faction chairwoman?Ayelet?Shaked slammed the move as a "surrender to the Americans" on?Sunday.

Speaking at a rally opposing the release of terrorists, Shaked accused the government of forgetting "why we are here and?how to?stay here. It started with giving in to terror in the Shalit deal and continues with surrendering to the Americans. For what?? She added that although Israeli agent Jonathan Pollard killed no one, and shed no blood, he is still sitting in a prison, decades later, despite appeals even from the prime minister himself.

Bayit Yehudi leader and Minister of Economy?Naftali?Bennett?has said that he strongly opposes the move and will vote against it when it is brought up for a vote at the cabinet.

Cleveland kidnapping victim Amanda Berry surprises concert crowd

Just a day after kidnapper Ariel Castro plead guilty, one of the three women held captive in his home for a decade made an appearance at a concert. TODAY's Jenna Wolfe reports.

By The Associated Press

One of three women held captive in a Cleveland home for a decade appeared at a public event for the first time since her rescue, a day after her abductor pleaded guilty in the case.

Amanda Berry made a surprise appearance at the daylong concert RoverFest in Cleveland on Saturday night, walking on stage with her family and waving at the cheering crowd. Wearing sunglasses and dressed in jeans and a black T-shirt, Berry smiled broadly while acknowledging the applause, but she didn't address the crowd. The rapper Nelly called Berry back to the stage after his music set.

The appearance came a day after Ariel Castro, a former school bus driver, pleaded guilty to 937 counts in a deal that will send him to prison for life without parole, plus 1,000 years.

Berry, now 27, Gina DeJesus and Michelle Knight disappeared between 2002 and 2004 when they were 14, 16 and 20 years old. They escaped in May when Berry kicked out part of a door and called to neighbors for help.

Berry told a police dispatcher in a dramatic 911 call: "Help me. I'm Amanda Berry. I've been kidnapped, and I've been missing for 10 years, and I'm, I'm here, I'm free now."

Hennes Paynter Communications

This frame grab image from a July 2, 2013 video courtesy of Hennes Paynter Communications shows freed kidnapped victim Amanda Berry, as she speaks at the law offices of Jones Day in Cleveland, Ohio. Berry made a surprise public appearance at a concert in Cleveland on Saturday.

Castro, 53, who was arrested and jailed shortly afterward, was accused of raping and beating the three repeatedly. He also fathered a 6-year-old daughter with Berry, authorities say.

The women didn't attend the court proceeding but said in a statement that they were relieved by the conviction and looking forward to the end of the legal proceedings.

Berry and the other women said she had accepted a ride from Castro, who had remained friends with DeJesus' family and attended vigils over the years marking her disappearance.

Castro was accused of restraining the women, sometimes chaining them to a pole in a basement, to a bedroom heater or inside a van. The indictment included two counts of aggravated murder related to accusations that he punched and starved one of the women until she miscarried.

Earlier this month, the three women offered thanks on YouTube for emotional and financial backing they've received since going "through hell and back."

New Discovery may Individualise Cancer Treatment

The research, published online today in Science, "increases understanding of the molecular mechanisms of action of PTEN, which is known to be defective in as many as half of all advanced cancers" says principal investigator Vuk Stambolic, Senior Scientist at the Princess Margaret Cancer Centre. Dr. Stambolic, a specialist in cell signalling, is also an Associate Professor in the Department of Medical Biophysics, University of Toronto.

In the lab, working with cell and animal models of cancer, the research team discovered what happens when the protein product of PTEN is lost or deregulated. Dr. Stambolic says: "We realized that the PTEN nuclear function links this tumor suppressor to the response to conventional cancer treatments, such as chemotherapy or radiation. This new knowledge, combined with our prior understanding of PTEN, provided immediate clues for individualizing therapy for patients with PTEN-deficient tumors."

Medical oncologist Lillian Siu, who leads numerous clinical trials at Princess Margaret, but was not directly involved in this research, says: "For clinicians, this is a significant finding that could help guide treatment decisions, especially considering that we can already test for PTEN deficiency by molecularly analyzing biopsied tissue, providing a biomarker for implementation of combined therapies that may be most effective."

For Dr. Stambolic, the discovery builds on his earlier research (Cell, 1998) which helped explain how PTEN loss promotes cell survival, another key feature of cancerous cells. "We now realize that the PTEN story was only half-told in 1998," says Dr. Stambolic. "The new findings, in conjunction with advances in molecular profiling and access to drugs already available or being tested in clinical development, present a tangible scenario to tailor treatment."

Verizon Galaxy S4 VRUAME7 Rooted, but No Bootloader Exploit

Its almost enough to make me switch to another carrier. I will stay with Verizon as long as im allowed to keep my unlimited data plan. When they try to take it away i will switch

Ehh, I might consider that but with travel VZW is really the only practical option.

Also, I think rooting/flashing is much less an issue these days. I ran my Rezound with the stock Sense for over 6 months with no problems. The Android updates, at this point, are pretty marginal. The bloatware is easily out-of-sight, out-of-mind. I don't even anticipate upgrading my phone for another year or two.

I sympathize with your feelings, but I don't feel anyone else has national service on par with VZW to make leaving viable.

JOHN HAEGER @ONEIDAPHOTO ON TWITTER/ONEIDA DAILY DISPATCH Terrie Lanz and his wife Ronda pose in their hotel room in Canastota on Wednesday, July 24, 2013.

ONEIDA >> After recovering from lymphoma two years ago, Terrie Lanz recently returned to the hospital with bone cancer, needing a jaw replacement. After spending almost three weeks in the hospital, Lanz didn?t have a home to return to - recent flooding all but destroyed it.

So now, Lanz and his family are seeking aid.

The surgery has taken its toll on Lanz. After removing part of his lower tibula to replace parts of his jaw and cutting out part of his tongue, he has a hard time speaking and walking. Lanz has had to return to the hospital every week in order to repair skin grafts and monitor his condition.

After losing his job as a press operator at the Oneida Daily Dispatch in 2011 due to press operations moving to Syracuse, Lanz has been on and off unemployment due to his medical condition. Finally in August, Lanz found a job working through a temporary employment agency in Oneida. He was hired full-time at the Hood facility in Vernon in November. Because of the short duration of his employment, he has been unable to receive disability for his surgery and inability to work during recovery.

To make matters worse, while Lanz was in the hospital after his surgery, his home was seriously damaged during the June 28 flood. Lanz, along with his daughter Emilee and wife Ronda, have been living in the Days Inn in Canastota for almost a month. They are not sure how much longer they can continue to live outside of their home.

Meanwhile, Emilee is on her way to Herkimer Community College, a process that was severely dampened when flood waters destroyed some of the necessary paperwork for her enrollment. She may not be able to go to school until the spring semester in January. Her graduation party, scheduled to take place at their home on Stoddard Street, was cancelled; however, the family is thankful for the Oneida American Legion, which hosted the event and helped with most of its costs, the rest donated by family and friends.

The family is currently living off donations from family, friends, Hood, the small savings they have left and the small salary their son Eric makes working for Ralston?s Party Supply. Lanz said he will have to undergo at least six months of recovery, but that process may be significantly longer due to radiation therapy.

?After everything and therapy, I?m not sure I?ll be able to stand for my eight hour shifts,? Lanz said, pointing to the skin graft on his leg covering the partial tibula. He said it will depend on his physical therapy results whether he may be able to work again.

Lanz and his wife Ronda said they are extremely grateful for everything people have done to help them, though they are not sure how they will continue to afford medical costs and the repair costs for their home. With both of their children hopefully going to college in the fall, they plan to get electricity restored to their home and live in the upstairs until they can get the first floor repaired; however, Ronda said she?safraid the stairs may be impassible for Terrie. They are waiting on state aid to see if they can begin repairing their home.

Lanz? family has set up a benefit to not only help with his medical costs, but aid the family in housing repairs and costs. The benefit will take place Aug. 17 at Jack?s or Better on Lake Road in Oneida at 1 p.m. The family will host basket raffles, food, live music and a 50/50 raffle. Entrance is $10 per person, kids under 12 get in for free. Tickets are available by calling 761-9681, 264-5269 or at Jack?s or Better.

Ashton Kutcher and director break down 'Jobs,' talk man behind the curtain

"It only takes one person to start a revolution," and after a special screening of the Jobs biopic, it's evident that Ashton Kutcher, the actor portraying the iconic Apple founder, believes in the credo.

On Thursday, film studio Open Road invited the press to a pre-release screening of Jobs in San Francisco. The film will open in U.S. theaters Aug. 16.

While we can't divulge on the film, a post-credits Q&A with direct Joshua Michael Stern and Kutcher gave us plenty of writing fodder.

The theater was packed with press and rather annoyingly, many had Google Glass in tow.

However, sporting the gaudy gear seemed appropriate for a film about the limitless boundaries of innovation, where during the question and answer session Kutcher eloquently addressed the importance of failing, and the need to encourage entrepreneurs in the breakneck world of tech.

Dissecting Jobs

Jobs' life was filled with troublesome relationships caused by his "prickly personality," which is putting it rather mildly.

Stern addressed how Jobs never lived in the past, rather relying on the present and focusing on future endeavors. For Stern, Jobs was loyal to his achievements first, and that required boxed up emotions and a lack of sentimentality.

Kutcher and Stern
To the crazy ones ...

When asked what his thoughts were on Jobs' mercurial cruelty, Kutcher explained that after much research, he believed the continued rejection in Jobs' life from his parents, people around him and the betrayal from his own company played a huge role in creating the famous, dysfunctional personality.

Kutcher said the result of Jobs' erratic, anti-social tendencies only pushed him harder to create products that people would love - because in loving the product, they essentially love its creator, an emotional process that Kutcher described as "very human."

The baseball hat-donned actor also added that despite Jobs' genius, there's clearly a kinder way to treat employees, and people in general - reassuring since Kutcher himself co-founded a media company and created a venture capital fund.

Kutcher walks the walk and talks the talk

When asked about the type of preparations he took on for the role, the infamous Steve Jobs gait was brought up.

With three months to prep, Kutcher said he tried to digest all of the books Jobs read (Edison, Ansel Adams, etc.), while researching Bauhaus and numerous other design concepts.

He even had hours of Jobs audio on a Soundcloud full of speeches he'd listen to while driving or walking, and even fall asleep to, in order to get the perplexing role right.

Kutcher
He takes his job seriously

Because Jobs often liked to be outside walking and hiking, and even having meetings in the fresh air, Kutcher did the same - which is when he would practice the peculiar hunched hop Jobs was known for.

Kutcher had his own speculations about this particular walking style. He felt Jobs' barefoot days in the 70s during college made him lift his feet higher to avoid stubbing his toes, a step he then simply carried on for the rest of his life.

The dedication of Kutcher's research to show us the man behind the curtain seems quite obsessive in nature (heck, it even put him in the hospital as reported earlier this year), and interestingly, provides another parallel to Jobs' own obsessive personality.

Kutcher catches fire

Personality and mop-top makeup aside, the tall bean-pole actor shares other similarities with Jobs: the ability to convey idealistic soliloquies with extreme passion as if his life depended on it.

Though his topics of discussion almost sounded like a valedictorian speech, Kutcher still won over the audience by expressing what appeared like genuine, articulate thoughts on the need for more never-give-up type of entrepreneurs in the tech sphere:

"We need entrepreneurs more than ever ? the great innovation that happens in the world is happening around technology ? we're doing an incredible job leading the world - the United States is building technology and we need to inspire people."

Kutcher
Chatting up fans

It seems like he's taking a page right of Jobs' book with his desire to tell others to rise up and be more, and to be better. Kutcher's zeal for tech is so transparent, he went on to mention Elon Musk or even one of the entrepreneurs he works with every day as being the next "god" to revolutionize tech.

Regardless of who it is, Kutcher adamantly stated that the formula for the next Jobs will require someone who is "driven, focused and works hard and fearlessly approaches failure, and falls down and gets back up."

For Kutcher, failing repeatedly will birth the next great pioneer in technology: "I guarantee you the next person who innovates that way will be someone who's failed many times in their lifetime."

Inaccuracies, schminaccuracies

Thought a lot more was said (as if there wasn't enough here already) about the portrayal of the iconic Apple founder, one issue raised were the discrepancies with reality present in the film.

Steve Wozniak has been vocal about this by telling Gizmodo how it was actually him trying to convince Jobs about the democratization of technology - Jobs apparently only wanted to make a quick buck and his lofty speeches seen in the trailers, "came much further down the line."

However, Stern claims Jobs always had an aura of mystery that no one could or would be able to unravel and that the film wasn't an exact science in terms of real events, but was as close as the filmmakers could get.

For Kutcher, near-perfect authenticity was also important, evident in his countless hours of research. But what mattered most to him occurred after a private screening held for the original Apple gang - a member strode up to Kutcher and said, "Thank you for giving me back two hours with Steve."

And really, that's all we can hope from the film.

?Another of those contacts from this year?s Game Developers Conference has paid off in spades! For those of you not familiar, GDC is a conference focused on and around, you guessed it, game developers. Not so much for media, the public?or military gaming charities looking for handout for the troops. Turns out the small indie motion tracking studio or four-man Android app development team don?t exactly have a lot of product to ship to the Armed Forces.

We did however run into Havok?on the floor. You may not think you know Havok and what they provide, but if you look at the logo, if you?ve ever played a video game, you?re probably familiar with their logo on the startup splash screen. Ever hear of The Last of Us, Call of Duty: Black Ops 2 or Battlefield 3? All three have Havoc engines in them in some capacity or another. So swinging by the booth there, Havok?s PR team was interested in getting involved with Operation Supply Drop, but they weren?t sure how they could help.

Flash forward a few months, and Havok comes out of left field with the makings of a full supply drop delivered to our door. They even had a series of Havok t-shirts printed especially for the guys downrange to commemorate their support! Pretty swanky! Also, a big shout out to EA who donated the games to Havok to send to us, which allowed them to donate the Xbox and controllers!

Why was doomed Spanish train moving so fast?

SANTIAGO DE COMPOSTELA, Spain (AP) ? By all accounts, the train was going way too fast as it curled around a gentle bend. Then in an instant, one car tumbled off the track, followed by the rest of the locomotive, which seemed to come apart like a zipper being pulled.

The derailment sent pieces of the sleek train plowing across the ground in a ghastly jumble of smashed metal, dirt and smoke.

But a day after Spain suffered its deadliest rail disaster in decades ? which killed 80 people and maimed scores of others ? one question surpassed all others: Why was the train moving so fast?

Investigators opened a probe Thursday into possible failings by the 52-year-old driver and the train's internal speed-regulation systems.

Experts said one, or both, must be at fault for the disastrous Wednesday night crash of the train that was carrying 218 passengers and five crew members to Santiago de Compostela, a destination of Catholic pilgrimage preparing to celebrate its most revered saint.

Instead, this stunned city of nearly 100,000 converted its sports arena into a shelter for the dead and the grieving.

"All Spaniards feel the pain of the families," said Spain's head of state, King Juan Carlos, as he and Queen Sofia met hospitalized survivors of the crash 2.5 miles (4 kilometers) south of Santiago de Compostela. The royal couple dressed in funereal black.

"For a native of Santiago like me, this is the saddest day," said Prime Minister Mariano Rajoy, who toured the crash scene and declared a national three-day mourning period.

The regional government of Galicia, in northwest Spain, said 94 people remained hospitalized, 31 of them in critical condition, including four children. The U.S. State Department said one American died and at least five others were hurt but cautioned that those figures could be revised upward.

The American victim was identified by the Diocese of Arlington as Ana Maria Cordoba, an administrative employee from northern Virginia. She and her husband and daughter were traveling to visit her son, who had completed the pilgrimage to Santiago de Compostela, according to Catholic News Service, a division of the U.S. Conference of Catholic Bishops.

Many victims suffered severe burns as the train's diesel fuel ignited a fire that caught some passengers trapped in mangled upside-down carriages. Emergency officials took DNA samples from the most heavily burned or the unconscious in an effort to identify both the living and the dead.

Rafael Catala, a senior transport official in Spain's Development Ministry, told radio network Cadena SER that the train appeared to be going much faster than the track's speed limit of 80 kph (50 mph) as it approached the city.

Breathtaking footage of the crash captured by a railway security camera showed the moment when the eight-carriage train approached a left bend beneath a road bridge at a seemingly impossible speed. An Associated Press analysis of the video indicated the train hit the bend going twice the speed limit or more.

Using the time stamp of the video and the estimated distance between two pylons, the AP calculated that the train was moving in a range of 144 to 192 kph (89 to 119 mph). Another estimate calculated on the basis of the typical distance between railroad ties indicated its speed was between 156 kph and 182 kph (96 to 112 mph).

The anonymously posted video footage, which the Spanish railway authority Adif said probably came from one of its cameras, shows the train carriages buckling and leaving the tracks soon into the turn.

Murray Hughes, consultant editor of Railway Gazette International, said a diesel-powered unit behind the lead locomotive appeared to derail first. The front engine quickly followed, violently tipping on to its right side as it crashed into a concrete wall and bulldozed along the ground.

In the background, the rear carriages could be seen starting to decouple and coming off the tracks. The picture went blank as the engine appeared to crash directly into the camera.

After impact, witnesses said, a fire engulfed passengers trapped in at least one carriage.

"I saw the train coming out of the bend at great speed and then there was a big noise," eyewitness Consuelo Domingues, who lives beside the train line, told The Associated Press. "Then everybody tried to get out of the train."

Other witnesses said nearby residents ran onto the tracks and worked to free survivors from the crumpled, flaming wreckage. Some were seen pounding rocks against windows, and one man wielded a pickaxe as survivors were pulled through shattered windows to safety.

Many aboard the train were Catholic pilgrims heading for Santiago de Compostela's internationally celebrated annual festival honoring St. James, a disciple of Jesus whose remains are said to rest in a church shrine. Since the Middle Ages, the city has been the destination for Christian faithful walking the mountainous El Camino de Santiago trail, or "The Way of St. James."

Santiago officials canceled Thursday's festivities and took control of the city's indoor basketball arena to use as a makeshift morgue. There, relatives of the dead could be seen sobbing and embracing each other.

The Interior Ministry ruled out terrorism as a cause.

While sections of the Spanish press pointed an accusatory finger at the train driver, government officials and railway experts cautioned that a fault in systems designed to keep trains at safe speeds could be to blame.

Jose Antonio Santamera, president of Spain's College of Civil Engineering, said one of the train's supposedly fail-safe mechanisms could have failed.

"The security system will detect any fault of the driver, (for example) if he has suffered a blackout and does not answer calls, and then starts the train's security systems. So I almost rule out human error," Santamera said.

He said the crash happened at a point where one speed-regulating system gave way to another, suggesting a possible failure at the handover point.

Spain's lead investigator in the crash, Judge Vazquez Tain, ordered detectives to question the train driver.

Train company Renfe identified the driver, Francisco Jose Garzon Amo, as a 30-year employee of the state rail company who became an assistant driver in 2000 and a fully qualified driver in 2003. The company said Amo took control of the train from a second driver about 100 kilometers (65 miles) south of Santiago de Compostela.

Renfe's president, Julio Gomez-Pomar Rodriguez, told Spain's Cadena Cope radio network that the driver had worked on that route for more than one year.

It was Spain's deadliest train accident since 1972, when a train collided with a stationary carriage in southwest Spain, killing 86 people and injuring 112.

"July 24 will no longer be the eve of a day of celebration but rather one commemorating one of the saddest days in the history of Galicia," said Alberto Nunez Feijoo, regional president of Galicia. Santiago de Compostela is its capital.

Passenger Sergio Prego told Cadena Ser the train "traveled very fast" just before it derailed and the cars flipped upside down, on their sides and into the air.

"I've been very lucky because I'm one of the few able to walk out," Prego said.

The Alvia 730 series train started from Madrid and was scheduled to end its journey at El Ferrol, about 95 kilometers (60 miles) north of Santiago de Compostela. Alvia operates high-speed services, but they do not go as fast as Spain's fastest bullet trains, called AVEs.

The maximum Alvia speed is 250 kph (155 mph) on tracks made especially for the AVEs, and they travel at a maximum speed of 220 kph (137 mph) on normal-gauge rails.

Other Spanish train calamities include a 1944 accident involving three trains that crashed in a tunnel. That disaster produced wildly disputed death tolls ranging from the government's official count of 78 to researchers' later estimated tolls exceeding 500.

In 2006, 43 people died when a subway train crashed because of excessive speed in the southern city of Valencia.

In 2004, 191 died when al-Qaida-inspired terrorists detonated 10 bombs on four Madrid commuter trains.

Pentagon delaying fighter jet delivery to Egypt

WASHINGTON (AP) ? The U.S. is delaying delivery of four F-16 fighter jets to Egypt in light of the military overthrow of Mohammed Morsi as president, but it has not decided whether to suspend military aid more broadly, the Pentagon said Wednesday.

Pentagon press secretary George Little said President Barack Obama made the decision to hold up the F-16 delivery while the administration continues to review options and consult with Congress on military assistance generally.

The four F-16s were to be delivered under a previously arranged sale of 20. Eight of the F-16s were delivered in January; after the four originally set for delivery this month the final eight were to be sent later this year.

The delay was the first direct action the U.S. has taken since the Egyptian military ousted Morsi and installed a new civilian government. Under U.S. law, military aid to a country that underwent a coup d'etat must be suspended. But the Obama administration says it is still trying to determine if what happened three weeks ago in Egypt was in fact a coup. Egypt is a key ally in the Middle East and the administration is reluctant to cut off the $1.3 billion aid package it sends to Cairo every year.

Little said Defense Secretary Chuck Hagel called Egypt's military chief, Gen. Abdel-Fattah el-Sissi, on Wednesday to discuss the administration's decision.

"We remain committed to the U.S.-Egypt defense relationship as it remains a foundation of our broader strategic partnership with Egypt and serves as pillar for regional stability," Little said.

"Moving forward, everything that we do and say will continue to be focused on hastening Egypt's return to a democratically elected government as soon as possible," he added.

Little said the Pentagon has decided to proceed as planned with a joint U.S.-Egyptian military exercise called Bright Star, which has been a centerpiece of the two countries' military relations for decades. Bright Star usually is held every other year, but the 2011 maneuvers were canceled following the revolution that ousted President Hosni Mubarak in January. Planning for this year's version was started in 2012.

Little said there is no timetable for proceeding with the delivery of four F-16s under a previously arranged sale to Egypt, and he was not specific about the reasons for delaying it.

"Just given the overall situation in Egypt right now we thought it prudent to make this decision," he said, adding that it ultimately was Obama's decision.

Energy Department Officials Prohibited From Talking To Investigators

Energy Dept Logo

The Washington Free Beacon reports that House Oversight Committee Chairman Darryl Issa has revealed that Energy Department officials have been prohibited from speaking to congressional investigators in a probe of the department?s illicit hiring practices. This certainly comes as no surprise from an administration that has a policy instructing federal employees to snitch on each other.

Rep. Darrell Issa (R., Calif.), chairman of the House Oversight and Government Reform Committee, revealed in a?letter?obtained by theWashington Free Beacon?that the deputy secretary of energy issued the gag order following a scathing inspector general report last week.

The report revealed that the Bonneville Power Administration (BPA), a division of the Department of Energy (DOE), had violated DOE hiring guidelines in ways that disadvantaged military veterans.

BPA employees who cooperated with the IG?s investigation, the report found, were fired, suspended, or otherwise sanctioned.

Issa revealed in a Wednesday, July 17, letter that Deputy Secretary of Energy Daniel Poneman ?verbally instructed Elliot Mainzer, the individual [Poneman] chose to serve as acting administrator of BPA, that no BPA employees were to talk with anyone regarding these allegations, including congressional investigators.?

Issa suggested that such a gag order could be illegal.

?Obstructing a congressional investigation is a crime,? he noted. ?Additionally, denying or interfering with employees? rights to furnish information to Congress is against the law.? (Read More)

As if anyone in this administration gives a hoot about following the law.

Speaking of the Energy Department, the woman Obama nominated to make their contracting more efficient ?struggled with financial management? while she was the CFO of NASA. To democrats fiscal mismanagement is a job requirement.

Gunmen attack Pakistan spy agency offices, kill 2

KARACHI, Pakistan (AP) ? Gunmen attacked a compound that houses offices of Pakistan's top spy agency Wednesday in a coordinated assault backed by explosives, killing two people, officials said.

Multiple blasts rocked the government compound in Pakistan's southern district of Sukkur just before gunmen opened fire on security officials there, said Javid Odho, a deputy Inspector general of police. Television footage aired after the attack showed damaged buildings and ambulance crews taking the wounded to local hospitals.

Pakistani Interior Ministry spokesman Omar Hamid Khan said the regional office of the powerful Inter-Services Intelligence agency appeared to be the target. Odho also said it appeared the agency's office was the target of the attack, though other government agencies also have offices in the compound.

Khan said at least three of the attackers were killed, while 37 people were wounded in the attack. Khan said it appeared the gunmen threw grenades before launching the attack.

No group immediately claimed responsibility for the attack and a motive for the assault wasn't immediately clear. Khan said police were investigating to see whether the spy agency had any important detainees being held in the office. Agency officials could not be immediately reached for comment Wednesday, though they typically don't speak publicly with journalists.

"It is an act of terrorism," Odho said. The police official declined to say whether he believed the Pakistani Taliban or any other militant group was behind the attack.

The Pakistani Taliban have declared war against the Pakistani state, killing thousands of civilians, police, army and other government officials in the campaign. Pakistan's southern port city of Karachi has long been a target of the terrorism, but attacks in southern districts like Sukkur remain rare.

World Bank gives Kenya $250 mln for welfare programme

NAIROBI (Reuters) - The World Bank said on Wednesday it will give Kenya $250 million over the next four years to go towards social welfare programmes to help the country's poorest citizens.

The east African nation will be the first African country to benefit from the program which already runs in Brazil and Mexico, the bank said.

Around 38 percent of Kenya's 40 million people live in poverty, according to World Bank figures.

The grant, known as 'Program for Results', will shield the poorest and most vulnerable households from effects of crises such as drought, malnutrition, and unemployment.

"Being cushioned against devastating income losses by a small but regular transfer of money from the program helps poor people afford consistent nutrition and healthcare, and keep children in school," Diarietou Gaye, World Bank Country Director for Kenya, said in a statement.

The plan will piggyback on existing social programmes run by the government for orphans, the elderly and other vulnerable members of the society, the bank said.

Neighbouring Rwanda also runs a similar social programme.

Kenya expects to have a budget deficit of 7.9 percent of GDP, or 329.7 billion shillings, in its 2013/14 fiscal year ending next June.

In recent budgets it has incorporated minimal grants from overseas as donors, concerned about allegations of corruption in government, cut back their aid.

Tiptoeing around corporate tax fraud at the G20 finance ministers ...

Finding a way to end legal tax evasion was the theme announced for the G20 Finance Ministers and Central Bankers Meeting in Moscow over the weekend, in preparation for the G20 Moscow Summit this coming September.

The sums lost to public treasuries through corporate tax leakages are stupendous. A 2011 study by the Tax Justice Network estimated the cost as in excess of US$3.1 trillion. When public austerity measures have created a world youth employment crisis, and sabotaged Greece, Spain, Portugal and the economies of other countries, stopping transnational corporations from stuffing revenues into tax havens and hiding profits from tax collectors should have wide support.

Why should citizens pay more so that corporations can pay less?

In Moscow, ministers and governors had before them an OECD report about increasing the tax take from multinational corporations. The OECD have been gathering a list of countries prepared to share information on how companies are taxed, and how much they pay. This is all to the good, but too slow, and not nearly enough.

Multinational corporations have an established set of techniques designed to avoid and evade taxes that have been well documented by the U.S. Congressional Research Service. Making these techniques illegal at the international level is needed, urgently.

The OECD report uses technical language to describe real problems. What it calls the erosion of the tax base, refers to the huge Internet-based companies such as Google, Amazon, or Apple, that make money in countries without paying taxes in those countries. Amazon may put Canadian booksellers out of business and inhibit domestic publishing, but like other digital giants, while it has Canadian customers, it pays little or no Canadian corporate income taxes.

The OECD focuses on what is calls profit-shifting. This is polite language for legal tax fraud. In a common practice, a company makes a loan to a subsidiary in a lower tax jurisdiction. The subsidiary pays interest on the loan and deducts it from its taxable income as a business expense. In some jurisdictions, under favoured treatment for dividends, the parent company then deducts the interest it receives. To summarize, a bookkeeping operation doubles the amount of tax not paid.

The main technique used by multinational corporations is to set artificial prices for internal transactions so as to book profits in low-tax or no-tax jurisdictions. This process, known as transfer pricing, suggests that corporate income taxes may not be the best way to get multinationals to pay their fair share. Instead, taxes on capital (corporate debt and equity) and financial transaction taxes may offer the most promise for defeating corporate tax evasion.

The OECD approach to corporate tax reform is to patch up its model tax treaty approach. Using promises of investment to follow, for decades the OECD has been encouraging countries to sign bilateral tax treaties. These are designed to protect corporations from double taxation of multinational profits (while as we see above, double non-taxation has become a problem). It makes little sense, particularly for countries with extractive industries (or foreign-owned manufacturers) to sign such deals. Poor countries with extractive industries are being gouged around the world as figures from the Revenue Watch Institute show.

Countries own the resource, and should sell it for the world price, charging steep taxes on producers for extracting the non-renewable resource.

Originally designed to meet the needs of American multinationals, bilateral tax treaties rest on the erroneous assumption that companies that organize the workforce to take money out of the economy are the ones that create wealth, and deserve preferential tax treatment, not the people who do the work, and pay dearly, for the non-payment of taxes by corporations.

The principle of paying taxes on economic activity where it takes place needs to replace the principle of paying taxes where corporations pay the least. Treating multinationals as a sole enterprise rather than as a fictional group of separate companies is entirely feasible. What is required is that a multilateral approach to corporate taxation be substituted for the bilateral tax treaty approach.

Politically, the analysis and debate of corporate taxation needs to be moved out of the OECD to the United Nations where all countries are present, and not just the major economic players regrouped in the G20. Putting resource taxation into context means major political issues of violence, corruption and armed conflict in resource extraction jurisdictions get addressed and not just the revenue needs of the wealthy nations.

Report: Luongo, Price among Canada camp invites

By Adam Gretz | Hockey writer

Roberto Luongo will probably be Canada's starter at the 2014 Olympics. (USATSI)
Roberto Luongo will probably be Canada's starter at the 2014 Olympics. (USATSI)

More NHL offseason: Rumors | Top 50 Free Agents | Buyout Tracker | Trade Tracker

When it comes to the 2014 Olympics, Canada's forwards and defensemen will be among the best (if not the best) groups in the entire tournament. They're so deep up front and on the blue line that their B team could probably be a favorite for a medal.

Goaltending, however, could be a different story as several teams (including the United States, Sweden and Finland) will be able to match up quite well with what Canada has to offer. In a short tournament that can be a pretty big advantage.

Sportsnet's John Shannon reports Canada is going to start sending out invites for its pre-Olympic camp on Monday, with goalie being one of the biggest question marks for general manager Steve Yzerman and coach Mike Babcock. The camp will take place in late August in Calgary. According to the report, Shannon is hearing Canada's goalie invites for the camp will be Roberto Luongo, Carey Price, Mike Smith, Braden Holtby, and Corey Crawford.

Luongo, the starter for the Vancouver Canucks, should be the early favorite to secure the No. 1 job, not only for his play at the NHL level, but also because he took over for Martin Brodeur during the 2010 games in Vancouver and helped Canada capture the gold medal. That leaves the other two spots up for grabs.

Perhaps the most surprising name on that list is Holtby, the starting goaltender for the Washington Capitals. His NHL numbers to date have been very strong, but he's only appeared in 78 games (regular season and postseason) at the NHL level.

As for the names not on that list, Brodeur, Marc-Andre Fleury, Cam Ward and James Reimer are some of the biggest goalies who, according to the report, won't be getting an invite. Brodeur has been a shell of his former self in recent years and lost his No. 1 job on team Canada during the last Olympics. Fleury was Canada's No. 3 goalie in 2010 but his stock has dropped like a rock over the past year on the heels of another disappointing postseason performance for the Pittsburgh Penguins.

The one player on the list who seems like he probably should have received an invite is Ward. He wouldn't be a lock to make the roster, but his play over the past four to five years seems to at the very least be on par with players like Smith, Holbty and Crawford.
